FOX News: Obama Can Appoint Supreme Court Justice After Senate Adjourns on January 3rd

Nightmare scenario-

FOX News reported this afternoon that Barack Obama can appoint a left-wing Supreme Court Justice after the Republican Senate adjourns on January 3, 2016.

Obama will then have 17 days to nominate a far left justice to the Supreme Court.

11 of 12 previous recess appointments were approved by the senate.

This came up in discussion after news broke that conservative Justice Antonin Scalia was found dead today.

This would be his last 'eff-you' to the American people before he leaves office.

God help us.

If this is true on Jan 4, 2016 Obama will be able to appoint anyone he wants to the Supreme Court and nobody will be able to do a damn thing about it!

The Senate won't have to approve anyone.

My guess? Say hello to Supreme Court Justice Eric Holder.

I’m unfamiliar with the part of the constitution that says a president can appoint a supreme court justice without the advice and consent of the Senate if they happen to be on recess.

That appointment would be replaced by the next president and senate, three weeks later.

If he does try an appointment, it is not likely anyone would accept a questionable permanency but, with the weird things going these last few years, who knows.

the problem with this is you assume the GOPe is going to do the right thing...the GOP won’t win the WH this year- it will be an outsider, Cruz or Trump, running on the GOP ticket- hence the GOPe would like nothing more than to make their job more difficult....
