That's automatic. Recess is another matter. There's a 3 month recess June, July, August?? when the politicians go home and a recess appointment can be made.

There's a way to have no effective recess.

The court runs from October till about the end of June so it would have to occur during that spring/summer recess but would only be good until the end of Obama's term...so nothing will be gained.

Obama got shot down by the courts on some of his appointments. He said they were in recess. The court said...like hell they were.

They don’t mean what they’re saying. In Jan 2017 a NEW senate is seated. Obama is in power until Jan 20.

1. If it’s a democrat senate he can win via nuke option.

2. The old senate MUST end and a new senate must begin. That. entails an adjournment of the old senate.

My thoughts exactly. A new president will have been elected by then, but not sworn in. The Senate can hold off a few days.

They have to. It's the end of the 114th Congress.

The time, it actually is The Recess that was argued when Obama tried to recess appoint the National Labor Relations Board a few years ago when Congress was technically in a pro former session.

If Obama did recess appoint, it would only last until 2018 when the Justice must then step down.
