According to the constitution, the president nominates supreme court justices. The senate can either confirm, or deny confirmation to the President’s nominee according to their conscience and/or electoral imperatives. The longest a position on the court has gone vacant recently is 125 days. Obama has 316 days left. The next President will also probably nominate at least two.
