‘Climate change’ lawyers quietly lay groundwork for EPA takeover of U.S. energy

Environmentalist lawyers have been pushing a legal theory that would give the Environmental Protection Agency cover to regulate every facet of state energy policy - effectively eliminating states' authority to craft their own regulations.

"Buried in the Clean Air Act is an extremely powerful mechanism that Daily Caller New Foundationeffectively gives EPA carte blanche to tell states to make drastic cuts to their emissions," Brian Potts, a partner at the law firm Foley & Lardner wrote in Politico Monday.

"This provision, which can now be used thanks to the completion of the Paris climate deal, raises important questions about national sovereignty and states' rights - questions that Republicans would undoubtedly use to try and kill such a proposal," Potts wrote. "But the benefits of using this mechanism dwarf those concerns."

Potts is referring to Section 115 of the Clean Air Act. Liberal legal scholars argue the Paris global warming treaty has triggered this little-known provision of federal law, and now the EPA can launch a full takeover of states' environmental regulatory agendas.

And NOT buried, in simple English, within the Constitution is an even MORE powerful mechanism, specially the 9th/10th Amendments, for the States to tell the Fed, and their lackeys in the EPA, or any other unconstitutional dept/agency/reg/rule/edict/etc., to FOAD.

It was never approved by the Senate. In fact they openly stated that.

But where did a little thing like the Constitution restrain Obozo from defying the Law of the Land. He operates under the Law of the Jungle.

I wonder if these same rules and legal theories would be applicable to killing state standards like California’s.

That would just make the enviros howl.

I could imagine that you can say state standards interfere with the national strategy.

Could you even argue that changing blends of gasoline between regions and from Summer to Winter contribute to climate change?

We already know that solar panels, wind mills, and electric vehicles make carbon emissions worse.

These are proven facts.

Then we are going to have to elect a President who is conservative, who will sweep in more conservatives to congress, who have guts and a back bone to either limit or abolish the EPA and a lot of other alphabet soup agencies including the Dept of Ed. Dept of ED is one of the most entrenched. Welfare needs reforming so only US Citizens are on the receiving end, change it to workfare. SS/Medicare Fraud is pegged at least $60 Billion. Each agency needs to be audited and waste and fraud dealt with. Reform where necessary if it can’t be eliminated, go after the people who commit fraud and fine and imprison them.

This is another area that needs to be addressed vacations and the cost there of, we should not have to provide clothing for the first family who are Millionaires and can afford their own clothes. Instead of private schools 1 or 2 private tutors would be less expensive and eliminate the need for a lot of SS for the guarding of offspring. Sir, you are wrong. it is time to do more than downsize DC. It is time to end it. Letting any portion of it live is as dangerous as if the Lord had allowed the Jews who sinned in Sinai live to enter the Promised Land. For two generations it must be denied.

At the root of it all this government wants to take over virtually everything. I have been reading a history of the Middle / Dark Ages. These days seem more like that, in terms of power grabs, than not.

I don’t think any of us can even conceive of just how radical this bunch of thugs in the government are. We have become weak like the Romans and these thugs have invaded the city walls like the Visigoths. The Dark Ages lasted almost a thousand years. You and I and our children and their children’s children will not see the end of this revolution we are in and it probably will not matter one whit what the outcome of the election is this fall.

This is why the leviathan gets larger and more out of control by the day.

Congress has completely abdicated its constitutional duty. These agencies have become effectively a shadow government with virtually unchecked power.

A rogue judiciary has entrenched that power over the years.
