ANALYSIS: No, Hillary Clinton Did Not Commit a Crime ... at Least Based on What We Know Today

It's critical to start by separating foolish and even potentially shady behavior from criminal. It should be clear to any objective observer that it was an enormous error for Clinton to use a homemade server for all of her emails while she was in a position that regularly handles and assesses the most sensitive of government secrets. She had admitted as much (although now she appears to be backtracking from that initial mea culpa).

It is also indisputable that it was neither a crime nor even a violation of State Department procedure for Clinton to have used personal email for government business at that time. Secretary of State Colin Powell, for example, used a personal email account from 2001 to 2005 in addition to his government account.

What makes this different, however, is that she created and maintained her own server in her home, and therefore controlled, all her emails, personal and professional.

True. But that's not what she'll be charged with. Because what she did with classified material IS a crime.

I don’t recall him during the OJ trial, and please correct me if I’m wrong, but I seem to recall him (with his standard issue - journalist tan trench coat) running after Ken Starr during Slick Willie’s impeachment.

I amm watching and waiting to learn

The one named after Sir Edmund falls into the category of situational ethics. The Baby Boomers went mostly into one form of ethics or another.

1) There are ethics based on Judeo-Christian values, What is right is right, and what is wrong is wrong.

2) The alternative is "Whatever I can get away with and serves me is right for me!"

I expect that most of her followers are those that admire her for her talents of setting her own rules.

She did nothing wrong, as her actions were totally what she intended. How dare the rest of us challenge her on her decisions.

The fat lady will be singing for many...Soon!

Secretary of State Colin Powell having classified Documents on his personal computer, needs to be brought to light. Just because someone does something illegal in the past and doesn’t get caught, does not make it legal in the future.

Author is basically putting forward Hillary’s defense, to wit: it was stupid, even bungling, but doesn’t involve the “guilty mind” necessary for conviction.

Problem is...”bungling” is one thing, going thru prolonged active measures to deliberately evade security and consistently do something obviously stupid for such prolonged periods that it becomes “reckless endangerment” tantamount to deliberate crimes - in this case, practically facilitating espionage just short of painting the server’s IP address on the garage door.

Author tries to argue “it wasn’t intentional”. BS. The State Department went thru great lengths to ensure she didn’t act that way, which she did anyway. Dunno if she did it to sell secrets to foreign powers, but close enough to make the charges stick - for decades.

If indeed he had classified documents on that personal server, hell yes, he should be investigated and if necessary, prosecuted.

That may be - but the obfuscation here is that classified material should never have been sent as email, period. She was clearly aware of it, condoned it, and instructed that markings be removed.

It was illegal, and she should absolutely be held to account.

It would be a tweener.......had the data on her computer only been unclassified, because she would have been in conflict with the federal regulations on archiving records.

When in the course of being investigated you erase half the evidence, and still don't manage to erase 1500+ emails containing classified information, you have a big problem. She was ultimately responsible for all the classified data for her department, yet was undermining all the safeguards for handling that data. That is definitely illegal.

He was a legal analyst during the OJ trial, and was actually pretty good. However, he became a real disappointment when he turned into a Clinton shill for Monicagate.
