ANALYSIS: No, Hillary Clinton Did Not Commit a Crime ... at Least Based on What We Know Today
ABC News ^ | February 1, 2016 | Dan Abrams

Posted on 02/01/2016 2:44:25 AM PST by Zakeet

It's critical to start by separating foolish and even potentially shady behavior from criminal. It should be clear to any objective observer that it was an enormous error for Clinton to use a homemade server for all of her emails while she was in a position that regularly handles and assesses the most sensitive of government secrets. She had admitted as much (although now she appears to be backtracking from that initial mea culpa).

It is also indisputable that it was neither a crime nor even a violation of State Department procedure for Clinton to have used personal email for government business at that time. Secretary of State Colin Powell, for example, used a personal email account from 2001 to 2005 in addition to his government account.

What makes this different, however, is that she created and maintained her own server in her home, and therefore controlled, all her emails, personal and professional.

New bumper sticker:
HRC - foolish and even potentially shady, but not criminal.

Danny appears concerned that he may not have the opportunity to vote for “the world’s first U.S. president” and therefore not be able to make “history.” What a jerk. You need to stick with taking “selfies” Danny. Leave the grownup stuff to grownups.

He’s flipped his wig!

That’s OK though - he has a dozen more.

The guy or guys who cut and paste the classified onto unclassified messages...are guilty of a number of crimes and probably will face at least ten to twenty years in prison.

Hillary should worry because if her messages went into a folder at the Clinton Foundation where Sid relayed them onto various ‘clients’....then that’s selling classified information (she is the one who told the State Department idiot to cut and paste.....so she knew it was classified. For that, you’d get ten to twenty years. It’s a question of if the FBI is willing to go walk into the Clinton Foundation and ask for a ton of information. On this part, it’d take at least two or three years to build a case from scratch.

She’s committee high treason pure and simple. We’re not talking only criminal acts here, but some along the scale of the Rosenberg treason.

unfortunately, treason requires two witnesses and/or confession. We all know that any witnesses have been eliminated and a Clinton never confesses to anything.

Abrams is a longtime Dem apologist and Clinton rumpswab. I’d take anything he says with a grain of salt. He had become known during the OJ Simpson trial as a legal analyst and only went full moonbat aftet the trial was over.

150 FBI agents may think differently.

Yes, but the purpose of this article is to bolster, in the publics mind, the DOJ's justification for not indicting Hillary.

Not that she’ll be indicted, because she won’t, but for media talking heads to try and “analyze” data they don’t have is nothing short of comical.

This stupid ***k just contradicted his own point. Powell HAD a government account.. Hillary did not.

Notice the deception? "It's not a crime, because a Republican did it too, although what we're claiming he did isn't exactly what Hillary did, but you won't notice unless you read carefully."

As a gov't contractor, I'm threatened regularly with fines and jail time for losing gov't data, although the stuff I'm handling isn't even considered "classified".

is there any RATIONAL person who believes HILLARY personally set up the removal of classifications and the onforwarding of classified information to her personal unsecure unencrypted SERVER?

that is what you have to believe for her to be innocent....

and to believe that you have to forget that she personally disciplined others in State for doing what she did....
and you ahve to forget that Obama specifically did not wnat Blumenthal in State. So he was “employed” by the Clinton Foundation and had privy to ALL OUR NATIONAL SECRETS, as well as Huma and Cheryl and her boyfriend...

the entire inner cirle are FELONS ..... and possible TRAIOTORS subject to what they did with the information and indicaitons are that it was passed to foreign governments and agents in retiurn for $$$ tot he Clinton Foundaiton and favorable business decisions in Uranium One and Hiti and other mining deals....

Hillary best get a good criminal DEFENSE ATTORNEY.....

Let Obama and Lynch play their politiacal obstrution of justice game......ask Nixon where that ends.... Congress can appoint a special prosecutor and finish the task at hand.... justice for all involved....

Any other citizen would already be serving out a sentence.

Who ever said this bunch of criminals are citizens? Americans in name only, but they should be deserving of nothing less than stripping of citizenship. And it is all mixed up with George Soros, who is only a naturalized citizen. He BOUGHT a US citizenship to escape prosecution in several other countries.

If no crime was committed, at least the stage was set for another to commit the crime (or crimes). This is known as being an accessory to the crime, and if a crime is actually carried out, the enabler is clearly guilty of contributing. Depending on the circumstances, this may not be necessarily a felony, but it certainly malfeasance of office.

Of course, if the hacking of the server was carried out by the same people who made huge contributions to the Clinton Family Foundation, then a clear quid pro quo exists, and it wold be difficult to duck the incoming heavy artillery aimed and zeroed in on oneself.

Herself and Slick certainly sold out much too cheaply, considering the mischief that would result.

Never steal less than a million and if possible, keep it all in round numbers. That way, it will appear at first to be a bookkeeping error.
