Ted Cruz is not eligible to become president

Republican presidential candidate Ted Cruz was born in Canada; he is not a "natural born citizen," and he is not eligible to be president.

And this is an issue that isn't going away, contrary to The Sacramento Bee's assertion, ("Trump's 'birther' lunacy, the sequel," Editorials, Jan. 7)

The Constitution is very precise: "No person except a natural born citizen ... shall be eligible to the office of President." The founders knew what they meant.

John Jay, later the first chief justice of the United States, wrote: "the commander in chief of the American army shall not be given to, nor devolve on, any but a natural born citizen." Later, one of the authors of the 14th Amendment, Rep. John Bingham of Ohio, wrote: "Who are natural born citizens but those born within the Republic?"

Congress has passed a statute that says if one of your parents is a U.S. citizen, you are an American citizen, too, no matter where you were born. Cruz's mother was born in Delaware. That makes him a "citizen" by statute, but not a "natural born citizen" within the meaning of the Constitution.

If both of Cruz's parents had been American-born, Cruz would have a stronger case. However, his father was born in Cuba.

Every other president and presidential candidate in our history was born either within the United States or one of its possessions. At no time ever was Calgary, Canada, where Cruz was born in 1970, a U.S. possession.

He lost his Canadian Citizenship the instant he voted in a US election. That’s the law up here. I know because my sister had dual citizenship.

Obama was born in Hawaii. When he was born he was an American citizen, and by virtue of his father, also a Kenyan citizen. He is not a natural born citizen. There is only ONE JOB he cannot have. He has it.

As you say the Constitution does not speak towards the qualification of a candidate- but state laws do.

The candidate or Party certifies to the state SOS that the candidate is eligible.

Ted Cruz lied in the debate. Trump’s mother was a U.S. citizen by naturalization at his birth, and Donald Trump was a natural born citizen as defined by Vattel’s Law of Nations, Calvin’s Case 1608, and the Naturalization Act of 1541.

Cruz obviously felt that he needed to formalize renunciation, but the timing of that renunciation is my issue.

A “natural born citizen” is a person who is born a citizen of the US and does not need to be naturalized. Cruz was born a citizen by his mother’s US citizenship. Case closed.

Even Trump agree he is eligible until Cruz started to get close to him in the polls.

The article makes an allusion that anyone born on U.S. soil is a natural born citizen. Not based on what I know of history. No way is an anchor baby of one of Obama's islamist refugee dreamers eligible to be POTUS. Talk about going from bad to worse, let's have an Arab nation use oil money to by the presidency through an anchor baby.
