What Tribe omits is that even originalists believe that the constitution can be amended. Any idea of women not being full citizens was clearly amended out of the constitution by the 14th and then 19th Amendments. So, the idea that any Originalist would say that men could pass on their citizenship to their children but not women is laughable and is simply Tribe trying to make us sound sexist.

Has anyone here studied the 1790 act where the term natural born citizen is used the only time ever by the founders

It clearly states the father has to be a citizen to be natural born if the child is born abroad

It’s not just liberals thinking we need clarification

And I like Cruz

Or Trump

I think no question Cruz is most originalist conservative

But this is really our first test case and the originalist viewpoint begs questions

And it’s being ignored

The Dems won’t ignore it trust me

Romney....both parents US citizens

McCain ditto and maybe born on us soil in Panama

Goldwater born on US territory

Dershowitz says, “He�€™s a natural-born, not a naturalized, citizen.” Dershowitz is a liberal who will not be supporting any Republican for president. He also wrote a recommendation for Cruz when he applied to be a clerk for former Chief Justice William Rehnquist. Rehnquist was impressed that Cruz earned such high praise from both a very liberal law school professor and a very conservative professor as well.

I missed the first part of the debate. Did Cruz claim that it didn’t matter what Tribe says because he is a Hillary supporter?

If this is what Cruz said it sounds like he shouldn’t have because it’s not true. Why do that? Cruz is sounding very flaky.

The other thing is regarding the birther issue - Did Cruz claim that Trump wouldn’t be eligible because Trump’s mother wasn’t a citizen? Did Trump’s mother not become a citizen?

Apparently Cruz’s own description of a natural born citizen was 2 citizen parents and born on the soil. Of course that had to be before he thought he might get into the WH.

Tribe was born in Shanghai, China, the son of Paulina (née Diatlovitsky) and George Israel Tribe. His father was from Poland and his mother was born in Harbin, to a family of Jewish immigrants from Eastern Europe. He was raised in the French Quarter of Shanghai. Tribe attended Abraham Lincoln High School, San Francisco, California. He holds an A.B. in mathematics, summa cum laude from Harvard College (1962), and a J.D., magna cum laude from Harvard Law School (1966), where he was a member of the Harvard Legal Aid Bureau. Tribe was a member of the Harvard team that won the intercollegiate National Debate Tournament in 1961 and coached the team to the same title in 1969.

Tribe served as a law clerk to Mathew Tobriner on the California Supreme Court from 1966–67 and as a law clerk to Potter Stewart of the U.S. Supreme Court from 1967–68. He joined the Harvard Law School faculty as an assistant professor in 1968, receiving tenure in 1972. Among his law students and research assistants while on the faculty at Harvard have been Barack Obama (a research assistant for two years), Chief Justice John Roberts (as a law student in his classes), and Elena Kagan (as a research assistant).

In 1978 he published the first version of what has become one of the core texts on the subject, American Constitutional Law. It has since been updated and expanded a number of times

I've read that, also read many other things about it all and long before Obama even thought about running for president; let alone Cruz.

In 2005, a man I know VERY well, was becoming a Naturalized citizen. The government handed out study guides, to those about to take the Naturalization test. This man aced the test and was THRILLED to be an American citizen. His wife happened to be preggers, at the time and he was very excited that his son ( they knew the sex of the baby and yes, his wife is a NBC ) would now be able to be president if he wanted to run.

So I have known about this since then and posted this stuff, when Obama was in the primaries.
