“Ted Olson is a private citizen. He is entitled to his opinion but it has no force of law. This issue has never been litigated. It needs to be.”

It amuses me to no end - Each and every election season we here at FR eat our own.

Nothing has changed over the last Four / Five election cycles AND nothing will change in this regard.

True, but a lot of folks here made a very big deal about Obama’s citizenship, Birth Certificate (BC), Fraud, etc, etc. I think it DID need to go to court and be resolved, one way or the other. But it was never... And those who opposed him on the BC were vilified as Birthers...

Now we are seeing the issue creep back up with Ted Cruz.

I don’t think that is necessarily eating their own, but rather just being consistent.

Now, had those going after Ted on this were previously dismissing Obama’s citizenship issues, then yes, that is eating their own.

Still, who is doing that?

We need to be consistent. It was proper and correct to question Obama's eligibility to be President. I really mattered if Obama was born in the US or not. If not, under the law at the time, his US citizen mother could not have transmitted citizenship.

Cruz has similar issues that need to be addressed. We need SCTUS to make a determination. McCain in 2008 had a non-binding resolution from the Senate declaring he was eligible based on the opinion of Laurence Tribe and Ted Olson.

Actually the SCOTUS stated:

Under Common Law, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners.

I agree about us eating out own. Afraid we will end up with Rubio as nominee because of it.
