Trump Tells Cruz to Take Citizen Issue to Court
Weekly Standard ^ | 1/7/15 | SHOSHANA WEISSMANN

Trump Playing Both Sides of Cruz Birtherism.

On Thursday, Donald Trump tweeted, ".@SenTedCruz Ted--free legal advice on how to pre-empt the Dems on citizen issue. Go to court now & seek Declaratory Judgment--you will win!"

Trump's tweet is the latest in a series of statements wherein he seems to be simultaneously fanning the flames on Cruz birtherism, and saying it won't be an issue.

On Wednesday, according to CNN, he said, "How do you run against the Democrat, whoever it may be, and you have this hanging over your head if they bring a lawsuit?"

"This was not my suggestion. I didn't bring this up. A reporter asked me this question," Trump said. He also repeated his assertion that Cruz has a Canadian passport, which Cruz denied during a separate interview Wednesday with CNN's Dana Bash.

Trump is just trying to help.....

How convenient, just when it looks like he will loose to Cruz in IOWA.

I know some people behave like this. They attack you but say it calmly and with a smile on their face. That way if you question why they where attacking they can say they where just trying to help...or they where just joking.

Dear Donald Trump,

I do not believe Ted Cruz needs your free legal advice.
Have you forgotten that his is a lawyer who has argued before the Supreme Court?

LOL

So Cruz should sue himself for running.

That is a brilliant idea,

Forget all those birthers thrown out of court for having ‘no standing’ in 2011.

Cruz has standing to sue himself.

Trumpster is a master lawyer too. No one else thought of this because they are not as smart as Trump is.

I’ve got some questions about Trump’s mental state.

I’m just trying to help but his father did have Alzheimer’s disease and Donald is no spring chicken.

Who is the plaintiff?

Cruz would be the plaintiff, seeking a declaration of his eligible status. The question would be, who is the defendant? I suppose the answer could be a state official in charge of elections, but there would to be a real "case or controversy," so Cruz could really only file such an action if there was some reason to believe that the official would likely bar Cruz from the ballot.

Methinks Trump should stick to his area of expertise, and stop handing out "free legal advice" (e.g., engaging in the unauthorized practice of law)

I think Trump is fantastic, and the only person that could beat Hillary, but this was a poor road for him to go down.

Coupled with his comments today about Obama being sincere in his crocodile tears - its a bit disappointing. But nobody is perfect I suppose - none of this is going to win him votes, it possibly cost him them.

Actually Cruz can go to court to request a “declaratory judgement” preemptively on a matter that he may be threatened by future lawsuits.

Gosh, if only we had an experienced SCOTUS litigator to consult on Constitutional matters.

OH WAIT...

wrong dude.....Cruz would be the defendant if there was anyone on the planet with “standing” to be the plaintiff. And there isn’t.

Not even Alan Grayson, tho we’re not sure he is from this planet.

Only someone like Trump would offer a former solicitor general, who has argued before SCOTUS multiple times, legal advice.

It makes as much sense as Cruz advising Trump how to stay out of bankruptcy.
