Charges and Specification

CHARGE I: VIOLATION OF THE UCMJ, ARTICLE 85
SPECIFICATION: In that Sergeant Robert (Bowe) Bowdrie Bergdahl, United States Army, did, on or about 30 June 2009, with the intent to shirk important service and avoid hazardous duty, namely: combat operations in Afghanistan; and guard duty at Observation Post Mest, Paktika Province, Afghanistan; and combat patrol duties in Paktika Province, Afghanistan, quit his place of duty, to wit: Observation Post Mest, located in Paktika Province, Afghanistan, and did remain so absent in desertion until on or about 31 May 2014.

CHARGE II: VIOLATION OF THE UCMJ, ARTICLE 99
SPECIFICATION: In that Sergeant Robert (Bowe) Bowdrie Bergdahl, United States Army, did, at or near Observation Post Mest, Paktika Province, Afghanistan, on or about 30 June 2009, before the enemy, endanger the safety of Observation Post Mest and Task Force Yukon, which it was his duty to defend, by intentional misconduct in that he left Observation Post Mest alone; and left without authority; and wrongfully caused search and recovery operations.

I thought the same thing. But, he was promoted to E-5 due to a rule we have for POW's. They are promoted while they are held captive by the enemy. Forgive me, I can't recall the time formula of rank VS. time. When they return, they are promoted to the rank they have achieved.

While I do not like this traitor being a NCO, the rule is a good one for those who serve with honor. It also demonstrates that they are not forgotten.

I think you are right which also explains the Army’s decision today to refer him for General Court Martial. I think for two reasons:

1. The Army brass have to be seeing the writing on the wall that just like they all covered their asses in Obamas time they better START covering their asses in the coming Trump or Cruise era.

2. Again, the brass have to NOW think that “well, Obama will pardon the bastard anyway so let’s look tough and swing for the fence” and prosecute him.

Some things being said obviously are designed to confuse the issue and public opinion. Having spent 7 years in the military though, I can tell all one thing and one thing IS NOT confusing in a VETERANS mind. And it is that If your ordered to “stand a post” in the face of the enemy and you don’t do it, you would be better off to just die on the spot. His life will be HELL in or out of prison.

Same here. I can’t say I even know anybody I was in the service with that would have EVER even CONSIDERED doing what Bergdahl is accused of doing and by some pretty upstanding folks with zero apparent reason to lie!

I say that IF HE DID WHAT HE IS ACCUSED OF DOING?.........and given the sorry state of the U.S. Army today, the man should be executed! You simply do not abandon your buddies in the face of the enemy.
