There are three levels of court martial in the military. They are Summary, Special and General. A general court-martial is the most serious level of military courts. The sentences imposed are the most serious. Depending on what he’s charged with, he could face penalties up to and including the death penalty. In a general court-martial, the maximum punishment is that established for each offense under the Manual for Courts-Martial, and may include death (for certain offenses), confinement, a dishonorable or bad-conduct discharge for enlisted personnel, a dismissal for officers, or a number of other lesser forms of punishment.
I would be surprised if they charge him with capital considering the politics involved. 50 years ago he would probably have been charged and convicted of desertion. The standard for conviction is pretty straight forward.

If he was supposed to be there and wasn’t, he’s guilty. The reasons why he wasn’t there would be considered during the penalty phase.

I would have to know the specific articles of the UCMJ that he’s being charged with. It sounds like they’re going for the most serious, though. Maximum penalty for violation of Article 85 are as follows:
(1) If a member deserted, but voluntarily returned to military control: Dishonorable discharge, forfeiture of all pay and allowances, reduction to the lowest enlisted grade, and confinement for 2 years.
(2) If the member deserted and the desertion was terminated by apprehension: Dishonorable discharge, forfeiture of all pay and allowances, reduction to the lowest enlisted grade, and confinement for 3 years.
(3) If the member deserted with the intent to avoid hazardous duty or to shirk important service (and example of this would be a member ordered to deploy to Iraq and then deserts to avoid the deployment): Dishonorable discharge, forfeiture of all pay and allowances, reduction to the lowest enlisted grade, and confinement for 5 years.
(4) If the member deserts during time of war: Death or such other punishment (such as life in prison) as a court-martial may direct.

Article 85: Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct.
No matter what happens, Obama will have him released, give him all back pay, let him continue in service if he so wishes...in exchange for another chance to grab his mama again.
A Presidential Pardon is definitely a possibility.

That’s a max of 5 years and a BCD.
He’s also charged with misbehavior before the enemy. That’s another pretty serious charge, but he’ll probably just get jail and a BCD.

No matter what we think about Bergdahl, he deserves a fair trial. Then he deserves to be shot.
