ATF Says Weapons Used in San Bernardino Shooting Were Illegal in California

More information about the San Bernardino massacre is trickling out as federal officials investigate details surrounding the attack on a county employee Christmas party. Many people, including myself, were curious about the firearms used since California has notoriously strict gun regulations. Reports of "automatic weapons" and even "semi-automatic assault-style weapons" seemed to be disconnected from California's almost uniform prohibition on such firearms.

Another reason the guns in question are important is that the left and its media handmaidens swiftly mobilized to beat the gun control drum...even before the shooters were permanently put out of business.

The media proudly reports that the firearms were purchased legally. They are trying to create the narrative that the current gun laws allowed this to happen. They want you to know "Hey, this was all legally done. We need more laws to stop this from happening again."

But not so fast. It maybe true that these guns were purchased legally, but they were not used legally and in fact, they were modified in violation of the California firearm laws says the ATF.

While they were originally sold legally, with magazine locking devices commonly known as bullet buttons, the rifles were subsequently altered in different ways to make them more powerful, according to Meredith Davis, a special agent with the ATF. The Smith & Wesson rifle was changed in an attempt to enable it fire in fully automatic mode, while the DPMS weapon was modified to use a large-capacity magazine, she said.

Those alterations made the weapons unlawful under California’s ban on assault weapons, which bans guns with magazines that can detach for quick reloading.

The state legally allows the sale and ownership of assault weapons that have fixed magazines.

If they have fixed magazines, then they are not assault weapons.

There is no such thing as an "assault weapon." It's a made up term to try and demonize firearms.

What? They broke the law and brought in illegal guns? Obviously, we need to strengthen the gun control laws even more so that no one has any guns...including any potential terrorists! (sarc).

Inquiring minds want to know how much did Obucketocrap know about the attack before it happened?

It seemed he had his speech ready before the last body hit the ground

How convenient of Obucketocrap to be in front of a mic when it was going down.

How convenient of Obucketocrap to know during the interview that automatic weapons were used before perps were caught.

How convenient that just a few blocks away the City was conducting a huge police exercise so that they were able to cordon off the area rapidly.

Yes, how convenient that the PoPo still do not have a MOTIVE..../s

I’m no gun smith but “I think” the trigger sear can be modified so it would fire full auto. The down side I think, unless one knows his stuff, is that once the trigger is pulled it won’t stop firing till its empty. Could be a problem :)

The presstitutes and White House have already lost interest in the bomb factory these 2 and other Islamists were operating in that house.

True. But you can bet that the FBI has not lost interest. They need to track down each and every bomb that was assembled there and find out where each and every one went. There could be 100's of bombs out there which originated from this cell.

The making of bombs is illegal. Anyone involved has to be found and dealt with.

Just as illegal and still as easy to procure.

Instead of making the guns illegal, California should have made Muslims illegal.

A true follower of Islam CANNOT be a US citizen according to the oath taken during the naturalization process. This oath is in effect when a citizen is born into US citizenship as well. The theocracy (a govt) that is Islam cannot co-exist with the rule of law under the Constitution and occupy US territory where the US law is in effect.

"I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen; that I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I will bear arms on behalf of the United States when required by the law; that I will perform noncombatant service in the Armed Forces of the United States when required by the law; that I will perform work of national importance under civilian direction when required by the law; and that I take this obligation freely, without any mental reservation or purpose of evasion; so help me God."

Note: In certain circumstances there can be a modification or waiver of the Oath of Allegiance. Read Chapter 5 of A Guide to Naturalization for more information. The principles embodied in the Oath are codified in Section 337(a) in the Immigration and Nationality Act (INA), which provides that all applicants shall take an oath that incorporates the substance of the following: Support the Constitution; Renounce and abjure absolutely and entirely all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which the applicant was before a subject or citizen; Support and defend the Constitution and laws of the United States against all enemies, foreign and domestic; Bear true faith and allegiance to the same; and

A. Bear arms on behalf of the United States when required by the law; or

B. Perform noncombatant service in the Armed Forces of the United States when required by the law; or

C. Perform work of national importance under civilian direction when required by the law.

The language of the current Oath is found in the Code of Federal Regulations Section 337.1 and is closely based upon the statutory elements in Section 337(a) of the INA.

As per the LEO press conferences, the jihadis had hundreds of tools for their IED factory in their home. I heard it right, hundreds they said. It would not be a stretch to believe they had the tools to convert an AR to automatic.

My understanding is that semi-auto AR15s are deliberately made so you cannot just drop in full-auto parts and everything will fit and work. I don’t know but my guess is the terrorists might have had illegal parts from an M-16 and they drilled holes or whatever in the AR15 but found the M-16 parts didn’t fit. I would never be stupid enough to try something like that or have reason to want to. But I have heard of stories about fools hacking the innerds of semi-auto guns and all they accomplish is committing a felony and messing up a gun.

Had the muslims not modified the legally purchased “assault weapons” described in this article, they would have legally killed and maimed?

Too many folks don’t get that doing criminal stuff like bank robbery and murder is already illegal.
