WACO - Defense attorneys representing bikers who were arrested after a shooting outside a Texas restaurant say they don't have access to key evidence because they refuse to sign the district attorney's unusual agreement to not share it with media.

The court will decide if the gag waiver is required, but not on Reyna's motion. He's withholding evidence, and you say defense is guilty of malpractice?
You are a real piece of work there, idiot.
But, hey, thanks for playing.
That's his goal, but he has to put up the appearance of a fight to make it "look real." His mission is to keep the evidence out of public view, including keeping it out of trials.
The government is better off losing trials and hiding evidence, than it is in showing the evidence. But it can't appear to be voluntarily throwing the fight.
The DA has inserted a condition into the discovery process that exposes the strategy of these huckster attorneys who want to deliberately leak evidence in an attempt to taint the jury pool and force a change in venue.
This waiver tactic is either acceptable or not in the eyes of the court, but it has nothing to do with the guilt or innocence of those bikers who were arrested. The notion that charges will get thrown out over this matter is absurd.
I just stumbled into the August 2015 Texas Gang Threat Assessment. I don’t recall this being discussed. It still only identifies one Outlaw Motorcycle Gang, the Bandidos.

Concurring bump...it does nothing positive for their clients either.
I would safely assert there are more criminals in automobiles than ever graced a motorcycle.
What a brave bet....... Now if you care to make the comparison on percentages, your assertion falls a part.
Its unarguable that there were more criminals at TP that Sunday than at any other restaurant at that same time in Waco, in Texas, in America.
Signing a “discovery waiver” looks like malpractice to me.
Abelino Reyno should obey the law.
LOL!
If I were paying someone who spent their time doing press conferences whining about the DA rather than working on my defense, I’d fire them pronto.
Who says he isn’t...besides your boy Broden and these other hucksters?
If you can listen to this and still disparage Clint Broden, then I will know we have nothing further to communicate about on this matter.
Will you listen to him?
There are a lot of rib joints in the country, not to mention other restaurants. Of those at TP who were arrested, (not even all the people there) only 1/3 had a criminal record.
So, if you want to play percentage games, I'd wager there are lots of places you could go in the USA where there are more than 1/3 in attendance who have a criminal record, and if you want to get near Washington D.C., it is likely there are more unindicted criminals in everything from the vicinity of a hot dog cart to the very best restaurants.
Just come out and say it. Somewhere, someone with loud pipes made you wet your pants, and you have never gotten over it.
Let’s see 150 guns confiscated from TP gangsters. Maybe your 1/3 had 3 each.........
Last time I took Texas CHL and unless the law has changed, it is a crime to take a firearm into a bar. Guess there were more than 56 ‘criminals’ at TP that day.
Been to a few damn rough joints, doubt there were 150 criminals there, but then again I don’t generally go to biker hangouts.
Anyone who imagines that most of those arrested won’t end up being convicted are dreaming.
If two thirds of the people arrested there had no criminal record, and there were a lot more people (no one specified who the firearms were taken from nor where the firearms were, except in a couple of instances) then that's 118 people who could legally have a firearm in their possession, just of the arrested. Add in miscellaneous unarrested but detained) people in the parking lot, and those who had more than one firearm with them, it wouldn't take much (in Texas, no less!) to count up to 150 firearms. All the police have to do is take everyone else's firearms, and they'd likely have that many.
Anyone who imagines that most of those arrested won't end up being convicted are dreaming.
We shall see, won't we.
In the meantime, there is that presumption of innocence thingy you just don't seem to get. Pejorative terms like "gangsters" really don't bolster your case, they just make you look like a wannabe jackboot.
Not in the Twin Peaks incident as it derives at least 51% of its income from food not alcohol.
According to Texas Penal Code Annotated Section 46.035 it is unlawful to carry a handgun (even by a licensed holder) in a bar: "(1) on the premises of a business that has a permit or license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic Beverage Code, if the business derives 51 percent or more of its income from the sale or service of alcoholic beverages for on-premises consumption, as determined by the Texas Alcoholic Beverage Commission under Section 104.06"
Therefore, Twin Peaks is a restaurant, not a bar according to Texas and a licensed holder CAN carry inside.
How easy is it to grab convenient figures out of thin air?
I will give you some benefit of the doubt that you may be correct on TP meeting that criteria.
You have intimate verifiable knowledge of the Waco Twin Peaks accounting?
As the old saying may be in order, “Figures don’t lie, but lots of liars figure”.
Gangster, let’s see, if it quacks like a duck, walks like a duck, swims like a duck, looks like a duck...... very likely its not a kangaroo.
You really are silly.
If you think you can tell who is or isn't a gangster by the clothes they wear, the vehicle they drive, or even the company they keep, I hope you have your retirement fund with Corzine.
The biggest crooks out there are wearing suits or clothes for the idle rich.
They aren't hanging out in restaurants where the waitresses are busty (not a titty bar), and they serve cheezeburgers and beer, unless the joint has at least 4 stars or is a family operation.
You act like people with no criminal record arrested on a fill in the blank warrant are all guilty. You would deny these people any presumption of innocence.
I sincerely hope you have no connection with law enforcement or the courts.
Your folks are the ones intentionally dressing like outlaws and acting like outlaws. Their intimidation of the public ploy is to look guilty. Terroism defined no differently than CripsnBloods or ISIS.
Crime is not a comparative activity.
My connection? Many that see this like me WILL be the jury. Don’t Mess With Texas.
