BALCH SPRINGS (CBSDFW.COM) - A lawsuit filed by a Balch Springs man raises serious questions about the police investigation into the shootout that left nine bikers dead outside a Twin Peaks restaurant in Waco.
That man claims that authorities are prosecuting him even though police admit that they have no evidence of his involvement.
It has been six months since that motorcycle trip to Waco left George Bergman out of money, out of work and in jail. The 48-year-old parked his bike at Twin Peaks and was walking to a restroom at the neighboring restaurant when he heard shots.

If he committed a crime why isnt there evidence? Didnt the cops have cameras running?
Being there with a bad thought is the crime.
It’s not like the old days when the cops could do anything they wanted to bikers. Anybody who can afford a Harley nowadays can most likely also afford a lawyer.
Nah, conspiring to further the operations of his criminal organization is the crime.
A lot of these outlaws just steal their bikes from the guys you are thinking of, then chop em up so they are unidentifiable.
And you believe that have evidence of THAT?
So, how many of the 186 does that irrelevant tidbit apply to?
Answer: None.
Gag order defy 1st amendment, we know that.
But they should also have a time limit. They should expire after 60 or 90 days, no be indefinite. Over 100 lives have been drastically altered, all for the benefit of LEO and higher ups. Corruption almost as high as heaven. Meant to say hell.

Good for him in defying that corrupt judge’s gag order! The truth has to get out!!!
They do have evidence on Bergman including video. Some of this was presented at his probable cause hearing and it directly counters what Bergman says.
The gag order was rather quickly overturned, then quickly reinstated. Reinstatement was immediately challenged and the judge who has it is taking his sweet time.
aka - Sandbags are cheap and effective when you have tons of sand and bags.
You mean that they claim to have video of him riding in “with David Martinez?”

It seems here, and other places, if you do not like the victim, the arrest was valid. A sad “state” of affairs.
There was every good reason to detain everyone in sight. That is how investigations work. Gather evidence to effect arrests.
Form individualized probable cause based on evidence obtained. Then arrest.
And that is how it was going, until (imo) Reyna wasn’t getting anywhere. Then the questioning ceased and they arrested everyone.
And thinking about riding the highways and eating meat served by buxom waitresses was bad.
Waco’s assertion: whatever they did was bad enough.
Agreed.
This story gets curiouser and curiouser as the days go by.
The problem now is going to be how to find the truth in all of this muddied water. I am sure it is there but, every one involved seems to be adding a little more mud every day.
I still think there are some latent Federal fingerprints on this.
