The legal noose around Hillary Clinton is getting tighter, Judge Andrew Napolitano explained this morning on "America's Newsroom."
On NBC's "TODAY" show, the former secretary of state appeared angry when asked about the House Benghazi Committee, arguing that the panel is conducting a "partisan political" investigation.
When asked about her private email server, she said that what she did was "allowed" even though it wasn't the "best choice." Clinton said each government official can determine which messages are personal and which ones are work-related.
Napolitano said the "noose" is tightening and that Clinton created these problems for herself. He said some of her statements to Savannah Guthrie in the NBC interview were "materially misleading."
He said Clinton is going to have to "explain away" to the Benghazi committee, while under oath, how she could have believed that some of the emails were not classified.
Napolitano said that there are over 400 emails, which have been made public, that were clearly "confidential, secret or top-secret."
He said the travel plans of Amb. Chris Stevens in Libya were contained in the emails, along with a photo of a North Korean military installation and other sensitive items.
"How could she even suggest that those were not classified materials?" he asked.
Napolitano said there is a legal "gray area" on government officials deciding which emails are personal and which ones are governmental.
"It definitely is not allowed under any circumstance, under any understanding of the law, for her to put classified material in a non-classified venue, which we now know she did over 400 times," he said.

So far Hillary has managed to get around the law. If the noose is tightening, she’s not worried.
Willy is slick, but Hillary’s slickness is hampered by her scales and barbs that keep getting caught in the web.

No there’s not. At least unless your last name is Clinton or Berger.
I guess that when HC says her email practice was “allowed”, that means that others knew about it (Obama/Jarrett) and didn’t bother to stop her. I’m sure they figured they could keep the knowledge in their back pocket for an opportune time to bring out.
Well, I'm not sure that you are a greater legal expert than Judge Napolitano, but if there is a genuine legal disagreement here, I'd like to hear what Rudy Giuliani has to say about this particular point. He used to be a federal prosecutor in the area of national security and knows this stuff very well. His interviews on Hannity have been very interesting (when Hannity lets him talk).
Did they ask Hillary if she thought the Senate Watergate Committee was a “partisan political” investigation also? She should know.
Let me know when some judge finally sentences a convicted HilLIARy to a real noose tightening!

The good judge still thinks laws and the Constitution matter. Not in Obama’s America they don’t.
If laws mattered she would already be indicted. There is more than sufficient evidence to do that.

All I care is she doesn’t make the Whits House whether or not she makes the Big House, but I think it would be funny if she did. I don’t really want that for anyone, but I can’t help it. Just the thought of seeing Hillary in the Big House makes me laugh. I also think it could very well do Her Arrogance a world of good, hopefully come out a different person. It’s happened to other hard-nut cases before.
Judge is an entertainer now and while he may have been a good judge his knowledge in this area is lacking.
The federal government has VERY clear regulations on the handling of classified information. I’ve been working with the regulations for 30 years. The regulations include specific guidance on determining what is personal and what is governmental.
But its really really easy. If its related to government functions then it is ONLY handled on government computers.
If its not related to government functions then it should NEVER be handled on government computers especially one intended for classified information.
Sending even one email containing classified information (especially the stuff she sent) over non-approved systems SHOULD result in immediate loss of job and criminal charges. I doubt it ever will though.
