In Volkswagen's Defense

First, let me say that I drive a Volvo XC70 - a 300 HP, 5000 pound, gas guzzler that gets about 9,000 miles per ticket -- and have never owned, or wanted, either a Volkswagen or an Audi.

It's unfair to hold today's Volkswagen AG accountable for the sins of its founders, but I have never understood how leftist anti-war protestors and peaceniks could commute to their riots in cars and vans whose design Ferdinand Porsche largely stole from Tata at Hitler's orders -- but then, I don't understand how adoring posters of mass murderers like Mao and Che Guevara with peace symbols and flowers makes sense either.

The bottom line on both observations, however, is that I don't like VW's cars, don't like the company, and have no friends who bought that company's products new - but none of this means that I can't see the upside of what VW is said to have done.

Specifically, it is possible to see their "defeat device" (basically a piece of software that detunes diesel engines during testing, but lets them run hot and clean in actual customer use) as an inspired bit of civil disobedience.

So, with that in mind, here's how Volkswagen could use the difference between the "de facto" real world application of the rule and the "de jure" world of law to defend themselves.

The legal defense is straightforward: the law generally requires these engines to pass EPA specified tests at the time of testing -- and they do. This is, in most jurisdictions, simple, black letter law: there is literally no legal substance to the charge against them.

The real anger should be directed at EPA and it’s dictatorial NOx rule that basically outlaws the diesel engine in an efficient high MPG tune.

From what I understand NOx isn’t a health issue - it’s a visual issue - it just causes regional haze.

Kinda weird how you follow the rules and regs that they wrote to the letter of THEIR writing and you end up being the one in trouble. Not unusual for liblogic 101. “You should have known what we meant even if we didn’t state if correctly.” As for finding a jury that would boot the case? Good luck. The prosecution would try to pack it with gorons who just want to save mother erf. As for NOx, I remember LA in the mid 60’s was pretty hazy. Today, a huge improvement. Well at least in ‘99 the last time I was there. More cars, roadways and people than 35 years prior so.............. Of course just about everything has the “Known in California to cause cancer” labeling. So any hose you buy in Cali, don’t drink out of it.

EPA measures "pollutants" per gallon burned whereas the effective measurement would be per mile traveled which measures total pollutants rather than some irrelevant incremental measure.

Diesels are more efficient and produce less of the nonfavored substances than gasoline engines that pass the standards.

An engine that produces one unit of pollutant per gallon but gets 50 mpg produces LESS total pollutant than an engine that produces .8 unit of pollutant per gallon but gets 35 mpg.

The Sting Ray "split window" was my first thought, too...and the only corvette design I liked.

As someone mentioned on an earlier thread, you use the “at time of testing defense” and back it up with lots of testimony from German Volkswagen engineers and even the judge will be weaping by the end of the trial.

I have a 2013 Grand Sport and my wife has a 2014 Stingray. I must admit that her car is far superior to mine. Rides nicer and the acceleration is quicker.

I will save VW lots of money. They can give me one of these defective cars and I won’t even ask them to replace the engine.

Lefties all are going to want something for nothing when there really is nothing wrong with the car, it just does not meet the govenment’s test standard.
