I leased the car, intending and expecting to purchase it off the end of the lease. If the solution is the installation of new software, or firmware, that has the effect of meeting emissions profiles that incidentally has the effect of lowering efficiency and reducing performance, this is really going to change the demand for the car on the used market 2 years hence. I'll be sure to offer to return the car at the end of lease, and see what VW offers, certainly a much lower buyout price than established at purchase.
Heads are most likely going to roll on a high level at VW over this.
About 20 hours after the news broke - I googled “VW Class action -emissions software” and found a law firm in Vegas that was already announcing a class action suit.
Seriously, the Germans are known here in MI for their engineering arrogance and do it my way or the highway even if it blows up.
I got to give them credit for having the cohones to think they'd get away with it and or no one would check.
Love to know the difference in MPG in this de-tune vs EPA tuning. This pretty much amounts to the software tweaks the Diesel guys have been doing with their trucks for years...

This is going to get VERY INTERESTING. Like it or not, the EPA and DOT has some SERIOUS TEETH here. Look for a mandatory recall to either reprogram the vehicles (and have them run like garbage), modify the vehicles (if that is even possible), or melt them down (which is what DOT does if you try to import a car without the proper paperwork).
The newer models may allow a remote software push, so unless you can get it off-line (i.e., cutting antenna lines, etc.), you may not have an option, if they are able to go with the software push.
Others that don’t comply with bringing in the car for the required modifications will simply be prohibiting from renewing their registrations.
Finally, we’re talking criminal violations - if I worked for VW, I’d be lawyering up as quickly as possible...people will be going to jail, either here or possibly in Germany.
I was in France a few years back, and had a Volkswagen CC TDI sedan with a 2.4L turbo-diesel. Fully packed with 4 adults and luggage, we averaged 42 MPG doing 75 MPH+ driving it around the country for a week or so.
I looked for the same car when we got back, and learned that engine was not available in the US. I pressed for an explanation, and learned that it didn’t meet EPA emission requirements. I learned also that the EPA rules looked at the amount of pollutants emitted per-gallon of fuel burnt, REGARDLESS of how many miles-per-gallon achieved.
So, for example, a car that achieved 20 MPG, and emitted X in pollutants burning 1 gallon over 20 miles would be approved by the EPA, while a car that achieved 80 MPG, and generates 2X pollutants per gallon, but only .5X in pollutants over the same 20 miles, would not be approved.
Got that? A car that generates 1/2 the pollutants in a real-world trip could be disapproved, while a lower MPG car could be approved.
I’m sure this is shocking to exactly no one here on FR - just another of the asinine EPA rules that don’t pass the logic test.
That’s not to excuse the behavior of VW here. But you have to admit it was pretty clever what they did.

There’s a train station next to where I work. In calm weather the there is a train parked there in the morning spewing God awful diesel fumes. My TDI doesn’t pollute one twentieth as bad. But, they’re going after VW.
BMW, Mercedes and GM all have 2.0 liter diesels, similar to the VW Group engine.
They all meet the same pollution standards, during the same time frame, claim the same fuel mileage as does VW Group.
Presumably it is possible to simply fix the VWs and Audis.
I intend to watch this closely, since I recently bought a 2013 VW TDI, certified pre-owned. My expectation based on advertising, is to enjoy years of high mileage usage.
Gina McCarthy has to find money to clean up her Colorado mess. What better scapegoat than the foreign auto makers.
