Hillary Clinton on Bill as Vice President: ‘It Has Crossed My Mind’

Hillary Clinton said the thought of selecting Bill as her running mate has “crossed” her mind, but added that she has been told it’s likely unconstitutional.

“He would be good, but he’s not eligible, under the Constitution,” the Democratic frontrunner said of her husband in an interview with Extra. “He has served his two terms and I think the argument would be as vice president it would not be possible for him to ever succeed to the position — at least that’s what I’ve been told.”

“It has crossed my mind,” she jokingly added to host Mario Lopez.

Like everything else in there, it's in plain English

"No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once"

The Amendment bars becoming President by being elected. It does not create Constitutional ineligibility to the office.

Amendment XII already says that a VP must be constitutionally eligible to be President, and the Twenty Second Amendment did not alter that requirement. Clinton is not eligible to be President under Amendment XXII, therefore he cannot be Vice President under Amendment XII.

Wrong.

He is 35 years old.

He is a natural born citizen.

He has resided in the United States for the past fourteen years.

He is no longer constitutionally eligible to be elected to the office of President.

He is certainly eligible to become President by succession to the office.

Please post the text of XXII that says he is not eligible "to be President"

That would have been an easy Amendment to write, but that's not the Amendment that was actually written or ratified.

No he isn't. A man ineligible for the Presidency is ineligible for the Vice Presidency. He could only succeed to the office as Speaker, President Pro Tem, and so on down the line.

Your hair splitting hasn't applied since the election of VP became contingent on the election of his running mate. Voting for a President implies voting for his VP and vice versa.

It was already written in Amendment XII, which has not changed. You’ve made this argument on many threads before, and you’ve been wrong every time.

From the 12th Amendment:

“But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.”

Doesn’t say anything about “to be elected.” So I believe your assertion is incorrect.

Do you believe that if either Bill Clinton or Barack Obama received 270 electoral votes for Vice President that the Supreme Court OR the Congress would prevent their inauguration?

Just to play Devil’s Advocate, how is Bill being VP and ineligible to be President, any different than when Henry Kissinger was 4th in line as Sec of State, but would have just been passed over, going to Sec of Treasury?
