Next, Oregon: Marion County judge refuses to perform same-sex marriages

PORTLAND, Ore. – A Marion County judge has refused to perform same-sex marriages and has asked his clerks to refer couples seeking same-sex marriages to other county judges.

Judge Vance Day, a circuit court judge and former chairman of the Oregon Republican Party, is now facing an ethics investigation over that decision, according to the judge’s spokesman.

Spokesman Patrick Korten said Day instructed his staff to tell couples that the judge will not perform same-sex marriages. The staffers were instructed to refer same-sex couples to other Marion County judges willing to issue them a marriage license.

Korten said Day took the action based on his “deeply-held religious beliefs.”

“It’s an exercise of his religious freedom rights under the First Amendment,” Korten said.

Day hasn’t performed any same-sex marriages since he joined the bench in 2011, but only stopped doing marriages of any kind this past spring. Judges in Marion County are not required to perform marriages, and Marion County’s website lists five active judges and one retired judge who are available for marriage ceremonies.

You’re welcome. Thanks for your observation. I get the impression that, legally speaking, there are going to be more unintended consequences, in the liberal zeal to impose homosexual marriage through court order.

Our society has turned into something where we are not a nation of laws, but a nation of what is not constitutional, therefore, we have a situation everything is legal unless the constitution says it is not, which if course is only defined by 9 people in the Supreme Court.

Post a notice that says you will perform the marriages on Monday afternoons between 2:00 and 2:01 P.M.

Barring the judge is “available”

I fear that, within the next five years, legislation will be put into place declaring that religious ceremonies will no longer be recognized. Only a civil ceremony will be considered valid for legal purposes.

That's fine. You go to your place of worship to get your "real" marriage certificate with the vows before God, and then later on you go to the government render to Caesar what is his.

The scriptures teach “to whom much is given, much is required” ... If anyone is skating on thin ice it is Rev. Franklin Graham ($ 800,000 annually) and other gutless Christian pastors in their amazing cowardly fear to not offend Caesar or Obama ... these so called spiritual leaders are pathetic ...

Perhaps this will give you hope. Franklin Graham has signed a pledge of civil disobedience, along with hundreds of other pastors, including James Dobson, entitled PLEDGE IN SOLIDARITY TO DEFEND MARRIAGE. An excerpt reads: “Our highest respect for the rule of law requires that we not respect an unjust law. A decision purporting to redefine marriage flies in the face of the Constitution and is contrary to
the natural created order. As people of faith we pledge obedience to our Creator when the State directly conflicts with higher law. We respectfully warn the Supreme Court not to cross this line.
We stand united together in defense of marriage. Make no mistake about our resolve. While there are many things we can endure, redefining marriage is so fundamental to the natural order and the common good that this is the line we must draw and one we cannot and will not cross.”
This pledge was also made by Rev.Graham on Greta Sustern’s Fox news show ON THE RECORD. Evangelical,Baptist,and Catholic leaders have made this pledge also. Because such a Pledge is, in fact, one also made to God, we can only hope for their sake and America’s that they ment every word of it.

Couresty follow up.

We wondered yesterday if any churches would discuss Kim Davis and her Christian civil disobedience.

Your post prompted me to ask FReepers about it.

Good news: a clear majority of FReepers have reported that their churches talked about and prayed for Kim today during services/mass.

So we need not fear that church leaders will ignore what is happening in Kentucky.
