KY Clerk who Refused to Issue Gay Marriage Licenses Held in Contempt and Ordered to Jail

Kim Davis, a Kentucky clerk who refused to issue gay marriage licenses got some rather bad news today, as a judge held her in contempt and has ordered her to jail.

Here are the details so far.

From NBC News:

A federal judge has ordered a Kentucky clerk to jail after she refused to issue marriage licenses to same-sex couples.

Kim Davis, a clerk in Rowan County, was found in contempt of court on Thursday morning. She has said granting marriage licenses to gay and lesbian couples would “violate God’s definition of marriage” and infringe on her personal beliefs as an Apostolic Christian.

District Court Judge David Bunning has said Davis is bound by an oath of office to perform her duties under the law, and ordered that she be jailed until she complied with his order to grant licenses.

Bunning has upheld the Supreme Court’s decision in June to legalize same-sex marriage nationwide, and wrote last month after the contempt lawsuit was filed that the state is merely forcing her to do her job within the law.

Davis, a registered Democrat, had worked as a deputy clerk for 27 years before voters in Rowan County elected her as clerk last November.

As an elected official, she can only be removed in a vote by state legislators, who don’t reconvene in the State House until January. While Davis certainly has the right to not be forced to do something against her conscience and religious beliefs, I feel that her continued refusal hasn’t really helped her cause any.

Rather than allow this get so far out of hand, perhaps she should’ve alerted the media to what was going on and then quit her job, using the exposure she would get from the situation to show her dedication to Christ and the gospel, which would be a super powerful testimony to believers and unbelievers alike.

Davis hasn’t chosen that course of action though, and it’s totally up to her to decide to do what she feels is best. I would’ve refused to issue the licenses as well, and would’ve walked out the door as a result.

Hopefully this will get resolved soon in a peaceful manner.

Meaning, Christians need not apply to government positions, right? Because if the next thing the government forces elected officials to do doesn’t comport with our faith, then off with their heads, right? Some people think FR is about pushing the Republican Establishment talking points of the day that they see on Fox News like “Trump needs to sign a pledge not to run third party, he disses Jeb for speaking Spanish, heck that’s the only language some people speak”

I think otherwise, the First Amendment and its freedoms of religion, speech and so on are worth discussing.

No. There are reasonable accommodations that can and should be made. Like I said, here, given that there were others in the office willing to do the job, let them do it.

Who said anything about agreeing with the decision? I think the Supreme Court got it wrong.

But not sufficiently so that you agree they should be defied.

Where is your breaking point? What must they do before *YOU* think they should be defied?

What law can an Article III court create? If you answered no law you understand the separation of powers.

So the SCOTUS simply said, in their putrid holding, that laws limiting marriage to one man and one woman were unconstitutional.

Fine. Kentucky’s laws concerning marriage are now unconstitutional. But Kentucky has neither amended nor passed a new law.

Article III courts can not tell states what laws to pass or not pass. Kentucky can just not license marriage at all.

So what law has Davis broken?

Kentucky could decide to have no law. It could have an entirely new idea. It could change the process.

But right now there is no Kentucky law that hasn't been struck down. Does the judge get to write a new law?

And so far as Kim Davis is concerned....your question is perfect. What law has she broken?

Is there some new law passed by the Kentucky legislature requiring her to issue marriage licenses on penalty of....what?

The stinking blackrobed pigs can do as they wish. It Seems the federal dictators are making laws illegally and handing out severe punishments for minor offenses. Think about it. She refused to give a couple of disgusting perverts a piece of paper and gets thrown in a federal prison where half the judges in federal positions belong themselves. This is communism, socialism, or nazism. It is a dictatorship by federal edict.
