Nobody is imposing anything, there are plenty of clerks around. Reasonable accommodations are to be made for matters of conscience for any government employee, it has always been thus.

Your other hypotheticals are just getting increasingly desperate. If reductio ad absurdum is going to be your only argument then you’re not really thinking about this.

I would say that anyone who agrees to issue licenses based on the whatever the state’s current take on marriage is has to realize that the state’s definition has always been mutable. The only way the state in the modern era has to define it is whatever judges, pols, or the voting majority think it is at any one time. It could be legit or not, depending. First was civil divorce and remarriage, then super easy divorce and remarriage, the latest and most ridiculous impossibility is ‘gay marriage.’ Who knows what else the state’s version it will be like in 50 years, probably banning actual marriage and mandating same sex underage clone marriage.

Assuming there even IS a recall petition, how much support is it going to get in Rowan County KY?

Someone needs to put up a competing change.org petition demanding that the KY Attorney General, who is a Democrat running for Governor, indict her for failure to perform her duties.

THAT would be a fun one to watch.

The obvious response to this should be thousands of armed citizens “hanging around” both the sidewalks around the federal courthouse and the judge’s private residence. Keep hanging around until he gets with it and releases her. Don’t shoot, don’t threaten, just be there.

Our say comes thru the ballot box. If our society hadn’t elected evil people to office, judges like Ginsberg and Kennedy would not be judges.

Congress could pass a federal law tomorrow giving all clerks in all states the right to refuse to issue a license unless no other person could issue one. Or they could take the matter out of the courts hands, or they could pass an amendment banning homosexual marriage.

They don’t because our society, as a whole, has decided to allow homosexuals to get government benefits available to married couples. Read the dissent Clarence Thomas wrote. Homosexuals have always had the right to marriage. They just haven’t had the right to government endorsement and benefits available to married people.

The problem is that our society HAS accepted homosexual marriage. I’m totally opposed, but I’m in the minority.

But this is a simple problem - can a county clerk refuse to comply with the law because she doesn’t approve of the law?

Those are denominational issues. This is not.

The Supreme Court's rulings are making it impossible for any traditional Christian or Jew or Muslim (for that matter) to hold public office.

As someone else said, religion is protected under the Constitution, "gay marriage" is not, and those religious protections have been understood to forbid any religious (or irreligious) test to hold public office.

In addition, the "gay marriage" ruling contravenes 5000 years of civil law and has no basis in any rational interpretation of the Constitution whatsoever: it is pure diktat by the elites to the rest of. Simply on the issue of civic equality, the court's orders should be refused.

Bunning should be tarred and feathered and given a one-way ticket back to his masters in DC.

I am aware that her previous multiple marriages are pre conversion and I’m happy she has given her life to Christ.

Now I want to play devils advocate for a moment. Did she refuse to grant marriage licenses to individuals who were shacking up? To women who were knocked up? To individuals who were on their 3rd marriage? Because all of these scenarios are sinful in the eyes of God.

USSC in Obergefell held:

“The Court, in this decision, holds same-sex couples may exercise the fundamental right to marry in all States. It follows that the Court also must hold - and it now does hold - that there is no lawful basis for a State to refuse to recognize a lawful same-sex marriage performed in another State on the ground of its same-sex character.”

For the moment I will stipulate to this part: “there is no lawful basis for a State to refuse to recognize a lawful same-sex marriage performed in another State on the ground of its same-sex character”

Here is the error:

“The Court, in this decision, holds same-sex couples may exercise the fundamental right to marry in all States.”

This commandeers the legislative process of the States. There is no fundamental right to legal recognition of any grouping of persons assembled for whatever purpose.

Judges are not Legislators.

It’s not like she’s going into GenPop at a Federal high security prison.

She’ll be treated the same as journalists who refuse to divulge sources and are jailed for contempt.

I’m not saying it’ll be pleasant for her, of course.

Also, keep in mind that she runs bible studies at the local prison. It’s not like the environment will be unfamiliar to her.
