Fox News anchor who shares same name as hamster toy sues Hasbro for $5M

A Fox News anchor says she’s no hamster—or choking hazard.

In papers filed in New Jersey Federal Court, Harris Faulkner says she’s suffered “substantial commercial and emotional damage” from a plastic hamster doll that shares her name.

And not one of the other Fox anchors — not Shannon Bream or Ainsley Earhardt or even Julie Banderas. Is Hasbro racist, saying a black anchorwoman is the equivalent of a hamster?

Is there any merit to Faulkner’s legal claims? Section 43(a) of the Lanham Act protects the names of celebrities in a manner similar to trademarks. Liability may arise if the plaintiff can establish that the defendant’s use would cause consumers to mistakenly believe that the plaintiff has endorsed or approved the defendant’s goods.

Agreed. It's not like it's a common name. Or like it's a natural name for some small animal. Somebody picked her out for some reason -- either they're attacking her or exploiting her.

If she doesn't mind paying lawyer's fees, I don't have a problem with her suing. Stuff like this may clog the courts and slow down other cases, but that's not always a bad thing.

Faulkner - the human being, not the toy - is a six-time Emmy-winning reporter with Fox News and anchors the weekly "Fox Report Weekend" show. The 49-year-old New Jersey resident, who has also worked at "A Current Affair" and substituted as anchor on "The Nancy Grace Show," is considered a rising star at the network, according to the lawsuit.

I agree in part with with Procon: She's a professional who anchors the weekend newscasts and now has her daily Fox News show ("Outnumbered"). I disagree with him regarding her lawsuit - her name is her brand; I'd hate to see the reaction to Hasbro coming out with a Hillary or Obama toy rodent (though it would certainly be more appropriate for both).

News reporter turned anchor who works at Fox News for 9 years. Used to work three years on Current Affair and at stations in Minneapolis, Kansas City and Greensboro. She once had a stalker that lead to a book and appearances on talk shows.
