Looks to me like we’re going back to the original mom and pop style economic model of yesteryear real quick. I don’t see how any of them can survive this.
I doubt anybody that follows the franchise model is too worried about this. In the court of public opinion and the market place they’ve ALWAYS been held responsible for franchise owners’ actions. The headline never reads “franchise owner breaks law”, it always reads “McDonalds accused”. So it’s always been in their best interest to make sure franchisees follow the law. It’s companies that subcontract stuff that fear this. Now every office building and their tenants needs to make sure the janitorial company they use follows all the laws. That’s where this one is going to get painful.
I can’t wait for all those temp’s at all the LAW FIRMS I go to, to START Filing Wage and Employment discrimination suits against the Biggest L:aw Firms in the World. If I read this correctly, they are now Considered EMPLOYEES, and the Law Firms will be LIABLE!
It's an open door for Unionizing all franchise ops. It has much broader implications.
The oldest, biggest, richest franchise organization in the world is the Roman Catholic Church. The 'rats would love to go beyond suing local churches to loot the Vatican.
To those large corporations that use the franchise model to pretend that they are a large group of small businesses in order to skirt labor laws I say: Screw 'em.
Large corporations will find some other way to keep their expenses low with the help of bought and paid for congresscritters.
And if they are too stupid to figure out to screw the American taxpayer, then to hell with them.
I'm sure it will be litigated all the way up to the dread pirate Roberts unless congress grows a pair and defunds NLRB...Ha, ha, ha ha, ha, ha...

Not really. This’ll hit the office environment a lot more. Those are the ones who’ve always been able to shrug their shoulders and say “we just pay the company to do stuff, we don’t know how they do business”. Franchise companies KNOW how their franchisees do business, because it’s all under the logo and one bad franchisee can kill the brand. McDs already does 2 on site inspections a year and goes over the books constantly, they already push to make sure the laws are followed.
Yep. The Constitution is NO LONGER OPERATIVE.
When do the States start going their own way?
why does not congress get to pass these laws?
