Ky. clerk again refuses to issue marriage licences to gay couples despite ruling

A Kentucky clerk's office on Thursday again refused to issue a marriage license to a gay couple, in defiance of a U.S. Supreme Court ruling that legalized same-sex marriage across the country two months ago.

Rowan County Clerk Kim Davis has refused to issue any marriage licenses, citing her Christian faith and constitutional right to religious freedom, since the landmark decision in June.

On Thursday morning, a deputy clerk in her office refused to issue a marriage license to William Smith Jr. and James Yates. It was their third attempt to get a license.

They said they will not give up.

"They just don't like gay people, they don't want us to get married," Yates said. "And they'd rather burn the earth and not let straight people in Rowan County get married either."

Scorched Earth policy would be detrimental to his side also. But I still do not see how this meets that level of rhetoric. I am sure they could find another JP if they really wanted that license. It is all about the media coverage and the possibility of a lawsuit.

What are they going to do...FORCE her? I doubt it. Are they going to arrest her? I’d like to see on what charges....all’s we needed was congressional leaders to do the same thing..defy an unlawful order.

Just off the top of my head, I think if the County Clerk doesn’t issue a marriage license then you can’t get married in that county. Whether one can just go to the next county over or not I don’t know.

But, yes, it is all about the media and lawsuits and politics.

They don’t want you corrupting marriage but I don’t think they give a stitch about gay people one way or the other as long as they steer clear of the children and don’t go around parading themselves looking for negative attention.

What happens to her if she’s impeached?

The legislature could remove her from her office, but I don't see that happening.

Just off the top of my head, I think if the County Clerk doesn’t issue a marriage license then you can’t get married in that county.

A marriage license is a state document. County clerks issue them as a convenience but you can get a marriage license in one county and then go to any other county in the state and get married.

The judge can order her jailed on contempt charges as well as fine her.
