Can’t end birthright citizenship without a Constitutional Amendment and that ain’t happening.

Deporting is certainly a good start. But I simply do not believe it will happen.

WHY NOT? The constitution has been interpreted many ways and many times. The Fourteenth Amendment test cases are few and misguided in my view.

I have doubts that round-ups and deportation will happen. Instead I think that E-verify will dry up jobs and that getting rid of this administration will dry up benefits by managerial direction.

What is taking place right now is encouragement of illegals by management (obongo) policy.

Congress can clarify the misinterpretation of the 14th without amending the Constitution. There is ample historical documentation that the writers of the 14th never intended it to apply to illegal aliens.

NOBODY has even brought up the Fourteenth Amendment stupidity in forever. It has not even been on the radar screen for almost all people... they don’t even know what happens. Anchor baby is something they don’t understand or challenge. It was never meant to be the way it is being done.

Many say that birthright citizenship is NOT what was intended in the 14th Amendment, and refer to the records of the Congressional debate which addressed that. The key phrase was "subject to the laws thereof." In the 19th century, they anticipated this problem, and in the debate about the amendment it was stated that children of foreign citizens born on US soil were subject to the laws of their parents' country.

The Amendment has been deliberately misinterpreted by those who favor massive immigration and dilution of the native citizenry. 20th and 21st century transportation makes the abuse of anchor babies possible in a way that could hardly have been imagined in the years after the Civil War when the 14th was written.

My understanding is that Birthright Citizenship is instituted by the Immigration and Nationality Act and not the 14th Amendment; therefore, a Constitutional amendment is not necessary.

birthright citizenship is not for illegal aliens..

there is no Constitutional right to it..

the 14th Amendment was meant only for the black slaves and their children..

and that bit about “under the jurisdiction” also proves that illegal aliens are not entitled to claim American citizen birth under that Amendment...the illegal aliens are intentionally breaking the law and are not under the jurisdiction of any part of the Constitution that they can claim as a qualifying reason for their anchor babies to be granted American citizenship..

also consider, if under the Constitution the children born here of foreign diplomats, who are invited guests with permission to enter and stay awhile, are denied citizenship, why on Earth would illegal aliens who are here without prior permission and have no respect for us or our country, gain such a high honor ???

Claiming American citizenship for their anchor babies by illegal aliens didn’t originate with a Constitutional Amendment and none is needed to halt the illegal practice and to strip the former recipients of the status..

if instead of receiving food stamps, welfare, free schooling free medical etc the illegal alien parents had o immediately start paying taxes, or a large fine for trespassing (or be jailed) before they could take the baby from the hospital, how many would be willing to come here to have their children ???

Easy...if you’re born here....of an illegal...you are not a citizen. Don’t think it takes a constitutional amendment.

The 14th Amendment NEVER granted citizenship to people here illegally. Those people are wards of a foreign nation, not the United States. Their children ARE NOT citizens.

In 1890s Chinese nationals who had children in the USA were NOT given Citizenship—even after the 13th Amendment was passed it was deemed that the amendment was only for Blacks.

Even if “birthright citizenship” is not resolved, Trump has resolved the conundrum (riddle, for you lurking lefties) of “anchor babies”. Even if the anchor stays, the parents leave.
But whoa! you say. That’s so heartless, td you ruthless bass-turd!
I’ve sat through countless sentencing hearings. I’ve heard the argument made: “But, but what about my children if I have to go to prison?”
The judge gives that argument about as much respect as the old, “Yeah I know I killed my parents, but now I’m a orphan yer honor.”

The children will be fine. Who cares about the criminal parents? CHINs—children in need of services—gets involved. These kids are at risk because of their irresponsible parents, so they become wards of the court. We probably paid for their birthing costs, possibly pre-natal as well.
If the lefties gets involved, who knows—the Sangers might kill them, so they stay out of it also since they are accessories before and after the fact, aiding and abetting these aliens entering this country in violation of our immigration laws.

Adopt the kids out, if the parents don’t want to take them with.
Deport the parents. Increasing jail sentences for each time they are apprehended. The palabra is passed down: ‘Go the Estados Unidos, get caught—and ju will—you get tossed out.’

Problema solved.

Your first shot out of the box is to tell me "IT CAN'T be ACCOMPLISHED because"

You're so used to having it shoved down your throat and accepted accepted it as well that it has now become your mantra.

I prefer to think that STRONG LEADERSHIP and a WILL to CHANGE can accomplish nearly anything.

Not true, it only require a different interpretation by the Court, or maybe the lazy do nothing congress can issue a clarification. The Court has al this power because Congress has let them take it.

The Congress can pass legislation interpreting the constitution as NOT having birth right citizenship to children of illegal aliens and deny the courts the ability to adjudicate it. As a matter of fact by statute Birth Right Citizenship is denied to children born in the U.S. to Diplomats and we can legislate that children of a non-citizen born here is not a citizen.

The lack of knowledge about the Constitution and the separation of powers is a primary problem with the entire government.

Many people think this has only been allowed due to a faulty interpretation of the Constitution.

If someone has the balls to actually seal the border; it would shrink way down in significance anyway.
