An Indian waiter in an Indian restaurant imagine that!
City bureaucrats slapped a $5,000 fine on a Midtown Indian restaurant for trying to hire a server who is Indian, according to official documents.
Following an inquiry by The Post, the citys Commission on Human Rights which cited the eatery two years ago said its assessing its practices.
Commission staffers have been trawling Craigslist to ensnare unwary restaurant owners who violate the law for things like seeking a waitress instead of a wait-person.
Thats gender discrimination by the citys reckoning and could lead to a four-figure fine.
They hit the jackpot in October 2013, when Shalom Bombay on Lexington Avenue placed an ad for an experienced Indian waiter or waitress.
It might be common sense that an Indian restaurant would try to hire a server familiar with its cuisine, but to the citys enforcers, it was a glaring red flag.
The law doesnt allow ads that discriminate based on national origin.
The commission filed a complaint, eventually scheduling a trial for April 15 at the citys administrative court.

And how does Hooters get away with obvious age discrimination in their hiring??? Hooters has obvious age discrimination, sex discrimination, and an intangible attractiveness discrimination going on with their hiring practices.
They just do not put that in their help wanted ads.

Not that I have any intention of visiting San Fagsicko, but you bring up an interesting point.
Every business in the United States is subject to Title VII of the Civil rights act of 1964 if they have 15 or more employees unless they qualify for a bona fide occupational qualifier (BFOQ):
“To prove the bona fide occupational qualifications defense, an employer must prove three elements: a direct relationship between the protected trait and the ability to perform the duties of the job, the BFOQ relates to the “essence” or “central mission of the employer’s business,” and there is no less-restrictive or reasonable alternative.”
It ultimately comes down to job duties and if a special trait is needed to perform essential functions. Most ethnic restaurants probably get off from this rule since they employee 15 people or less.
You have to advertise for: “Cast Members who will work as food Servers. Appearing and speaking like someone from India is required. Food Service experience a plus.”
The same way Disney gets away with hiring only caucasian women to be Snow White. They call them "cast members".

I tried to put in ad in the local newspaper to sell a “sissy bar” that I had on my motorcycle and the ad got rejected as hateful and discriminatory.
In my youth I worked at a number of gas stations. I got along great with the white boss at a Texaco station, until he sold it to a Mexican boss. The Mexican guy brought in his own crew getting rid of all others but retained me for a while. Because I was mangling Spanish when answering calls from customers, I got let go after a few weeks for not being Mexican. Go figure, I thought knowing English was good enough in America. Didn’t matter, as the guy was a crook, cheating his customers (all races including the Mexicans), so I was glad to leave. If it happened now, I could sue!
Every day I am amazed at how f-ed up the world has become. A business is disallowed from hiring the kind of people it wants. It wants what it wants. They want a certain look or ethnic makeup or size or age ... so what? Go submit your application someplace else if you're not what they're looking for.
Oops, sorry. For one moment there I thought litigious lawyers weren't running our society. My bad.
Because guys look stupid in the uniform, and they, along with old, ugly women don’t get tipped. The problem solves itself.

Another example of the bureaucratic tyranny pervading our lives.
SAfter a couple years, we hire a shop floor manager that was "Mexican" if you will (No more than I am), and the Philipino content started dropping fast, replaced by what you would guess.
No matter to me, I was the engineering manager and got along with all of them. Often did hands on training on the assembly line. Helped being a native of SoCal and they knew it.
They all worked hard, some harder to communicate with than others.
Company pot lucks were always memorable events. My step mother asked the other day (don't you guys ever cook American food?)

I thought all they hired was boobs- well, I guess their hiring practice could entail “Boobs needed” which would cover both men and women as men can be boobs sometimes- then they could be denied the job on the basis of I dunno, maybe manners or something-
But seriously you bring up a good point- won’t be long before hooters is sued for ‘discrimination’ and you’ll see men prancing around in tight shirts there- of course it will drive away the male customers- but that won’t matter to the prissy men who sued hooters-
