Indian restaurant fined for trying to hire Indian waiter

An Indian waiter in an Indian restaurant — imagine that!

City bureaucrats slapped a $5,000 fine on a Midtown Indian restaurant for trying to hire a server who is Indian, according to official documents.

Following an inquiry by The Post, the city’s Commission on Human Rights — which cited the eatery two years ago — said it’s assessing its practices.

Commission staffers have been trawling Craigslist to ensnare unwary restaurant owners who violate the law for things like seeking a “waitress” instead of a “wait-person.”

That’s gender discrimination by the city’s reckoning and could lead to a four-figure fine.

They hit the jackpot in October 2013, when Shalom Bombay on Lexington Avenue placed an ad for an “experienced Indian waiter or waitress.”

It might be common sense that an Indian restaurant would try to hire a server familiar with its cuisine, but to the city’s enforcers, it was a glaring red flag.

The law doesn’t allow ads that discriminate “based on national origin.”

The commission filed a complaint, eventually scheduling a trial for April 15 at the city’s administrative court.

Just put “must speak Punjabi” on every such Wanted ad. It’s a safe way for an Indian business to filter out the undesirables (whites, blacks, non-Indians etc.)

No matter what an entity does in this society, they are breaking a law waiting for this kind of crap to rain down on them.

Some years ago some guy tried to get hired there and made a big fuss about. He just couldn’t pull the uniform code. It was ugly.

I remember reading an ad for bartenders to work a club that included the phrase "must wear hotpants". I assume that would eliminate normal males from the applicant pool...

SAfter a couple years, we hire a shop floor manager that was "Mexican" if you will (No more than I am), and the Philipino content started dropping fast, replaced by what you would guess.

I see no problem with private companies hiring "their own". The government is too intrusive, and should only monitor government hiring. That Mexican guy brought in an all-Mexican crew, except for me. I grew up in an area with hispanics and learned some Spanish, although not fluent. I enjoyed eating genuine Mexican at my friend's homes, and did some conversing with their parents who only spoke Spanish. Later on I took classes in it.

My figuring is that a company lives or dies by who they hire, so let them hire whoever gets the job done for them.

Here's another story: when one of my sisters was younger she worked at a medical office in SF doing clerical work. She went by her maiden "white" name, even though married to a Mexican guy. Anyway, the medical office was hiring and going over applications for positions. The staff was checking names, and immediately tossing applications in the trash that had Spanish names. My sister was livid because when she complained, the bosses said "we don't want those kind of people here!". Blatant discrimination. They had no idea she was married to a Mexican. Here's the kicker - all the bosses were gay. They claim discrimination when it comes to them, but they're the racists. My sister quit.

Next time I eat at an Indian restaurant I suppose my waiter will be a black lesbian or a Caitlyn Jenner tyranny look alike
