The butchers at PP haven’t gotten the memo that more people get their news online and vids from youtube than network news. Arrogance, cruelty AND stupidity, what a combination.

I went and read the whole post at the link.

The only ‘threat’ was the (post) author's decision the put the word ‘threat’ in his title.

I see no threat or hint of a threat in the letter that PP sent, shown at the link. Nothing about a lawsuit mentioned.

It was an appeal. Their argument is ridiculous, but it was not a threat/.

I was reminded of a sitcom episode where the main character got handcuffed to a criminal who at one point was looking for a brick to “pound her hand off” in order to not be chained to her.

Later, he drank all the juice out of her fridge and she complained.
He said “I just threatened to pound your hand off and you don’t think I’d drink all the juice?”

Furthermore, when they claim that the process of picking through the remains is medically necessary to ensure that the mother doesn’t get an infection (which sounds plausible), all they do is PROVE that there’s no ADDITIONAL EXPENSE involved in separating the tissue by type.

What they’re trying to ensure is that every bit of the baby came out. While doing so, they’re sorting the “specimens” for the PROCUREMENT SPECIALISTS (procurement is a wonderfully apt term; pimps) so there’s no additional expense for the “not for profit” involved. Thus, there should be no fee charged.

If they’re allowing the third-party procurement specialists to do part of THEIR “medically necessary” work, then arguably the tissue mining company ought to be paid by Planned Parenthood for the service they provide in ensuring that Planned Parenthood’s patients don’t get infections.

A good analogy would be warning TV stations not to show film of a car wreck, where there’s blood on the road. Those patients didn’t consent to have their tissue (in the form of blood) filmed for broadcast, either.

Bobby Jindal agrees with you:

“They try to defend themselves by saying this is health care and patient-centered,” he said. “This is not health care. Abortions are not health care, and this is not about the patient. The patient in this case is that unborn baby. They’ve got no concern for the unborn baby, and you can see that in the video.”

Jindal also dismissed the famous Bill Clinton phrase calling for abortion to be “safe, legal and rare,” saying, “Well, it’s never safe for the baby, first of all.”

And if someone had some stray footage from inside Birkenau, they should sit on it for patient confidentiality reasons?

The slaughter of innocents for profit is a slaughter nonetheless, and just because they now claim that successful treatment of these little patients is 'confidential' even though that treatment not only results in their death, but being parted out like an old car, does not excuse their actions.

These little ones cannot speak for themselves, but worse, every one who pays their taxes and does not protest this is complicit in the slaughter.

I am not admitted in the Dakotas, but this is legal and PR idiocy.

#1: Unless they are claiming someone other than the fetus was videoed and “published” (the legalese for broadcasting, etc) by claiming the aborted fetus has the same rights as a human being, since the various medical privacy laws are designed to protect human beings, they have opened themselves up for huge legal attacks on the whole abortion issue problems in the future.

#2: The claim the videotaping was illegal will be driven under state law. Some states cover ALL recordings under their “wiretap” laws. Some require consent of all parties to the recorded conversation, others only require one party. It's the Linda Tripp recording of Monica case all over again, In addition, there is the matter of expectation of privacy. Can the PP officials claim they expected privacy with other diners, waiters all in area? I think not.

It's like what a client tell a lawyer, behind closed doors in the lawyer's office, after the client has defiantly retained the lawyer is sacrosanct. On the other hand, some perhaps client blurts something to me as we're on the Washington Metro or in a cab with a driver possibly listening, the expected confidentiality of that is very attackable.

#3: In intimating the organization is doing something illegal, they are opening PP to litigation. It would not be a great case, but I've won a lot of “not great” cases.

#4: PP is condemning undercover techniques TV stations love, and use call the time. A station's reaction to that would be: “So ????”

#5: Finally, and worst of all, the PR idiots at PP are drawing huge attention to the new story! This was the 3d in a series, and a bit of old news now. It would not have received nearly the attention it will now due to the idiots at PP drawing attention to it.

. It's like when a Capitol Hill newspaper printed an opinion piece claiming to identify the 12 Dumbest Members of Congress. (It was a tight race to make the 12)

It was a little space-filler story that went nowhere, until a Member from Arkansas called a televised news conference to claim that, no, despite what the newspaper said, he was NOT one of the 12 Dumbest Members.

The story that no one in Arkansas knew or cared about suddenly became the lead story on every Little Rock station!

You would think PP would have a good PR agency. With an issue like theirs, they need one... but this will make the textbooks on how NOT to do crisis media.

The “patient” is dead, so does s/he have any privacy rights? Don’t think so.
I'm sure they consider the mother the "patient". But, regardless, HIPAA requires privacy maintained long after a person's death (50 years, IIRC), so they shouldn't be divulging any private information of either the mother or child to the video makers.

The fact that they are willing to implicitly admit that they violated HIPAA privacy rules in order to attempt to smear the video makers shows how desperate they are.

But there is the issue of identification as an element of privacy.

If you don’t ID a person, or they self identify, how can you have violated their privacy?

I believe the law refers to “individually identifiable health information” of a “deceased individual.” Since Planned Parenthood and others who support abortion don’t believe the fetus is an individual in the first place, then I hardly see how they can argue privacy violations. The disembodied parts were certainly not “individually identifiable” with regard to either the dead fetus or the donating mother.

In addition, (HIPPA not my area) whose activities does HIPPA restrict?

Media? LEOs, citizens?

Example, man is in ER because he got stupid and fell out of tree he was trimming. Unbeknownst to to ER, wife is making video to show her family how stupid he is.

Curtain is drawn back and pt in next cube is recorded.

Violation in the recording? If played on TV? If shown in small private gathering? Usable in malpractice action by ER to defend? By pt in next cube to sustain their case?

The Center for Medical Progress (CMP) is an extreme activist organization whose sole mission is to prevent women from accessing health care and to destroy Planned Parenthood. The board members of this group believe that abortion is “genocide,” and employ people who went to jail for attempting to bomb a women’s health clinic. They are also connected with the man who murdered abortion provider Dr. George Tiller.

And Planned Parenthood is "connected" to Adolf Hitler. And to another famous racist who hated poor people.

Unbeknownst to to ER, wife is making video to show her family how stupid he is.
HIPAA is limited to medical personnel.

The point I'm trying to make is that in order for the undercover video makers to have released any HIPPA privacy information, that information must have been provided by the Planned Parenthood people.

I don't think the video makers violated any HIPPA rules, but for Planned Parenthood to even make the claim, they would have to admit that they also violated the same rules.
