Scalia Slams Roberts as Biased In Obamacare Cases

I​n a blistering dissent from the majority in King v. Burwell this morning, Supreme Court Justice Antonin Scalia said President Obama’s signature domestic policy achievement should be called “SCOTUScare” rather than Obamacare, in light of how many times Chief Justice John Roberts has intervened to protect the law from a crippling legal defeat.

Scalia argued that Roberts rewrote the law twice in 2012, and has now done so a third time in his King decision, which allows the IRS to continue providing subsidies to people who purchase insurance in the federal government’s health-care exchange.

“The somersaults of statutory interpretation they have performed (‘penalty’ means tax, ‘further [Medicaid] payments to the State’ means only incremental Medicaid payments to the State, ‘established by the State’ means not established by the State) will be cited by litigants endlessly, to the confusion of honest jurisprudence,” Scalia wrote in his dissent. “And the cases will publish forever the discouraging truth that the Supreme Court of the United States favors some laws over others, and is prepared to do whatever it takes to uphold and assist its favorites.”

G W Bush new what he wanted out of Roberts when he nominated him for the Chief Justice, and Bush is getting exactly what he expected. NWO ho.

Roberts could have been blackmailed. He did change his mind in the last hour the first time and then rewrote ObamaCare.

I never gave this theory in credence before, but now it is hard not to believe he is being intimidated or extorted into voting the way the Chicago Mafia administration orders.

They've got something on him, but I don't think it's that constantly repeated issue about his adopted children.

Yeah, remember this was a 6-3 decision.

I’m guessing that since the Chief Justice gets to pick who writes the decision, he voted with the majority so he could write it himself.

Not defending Roberts, but there are some really interesting tidbits in the ruling that point to a desire (at least in part) to absolve SCOTUS from any culpability in a death spiral collapse of Obamacare.

Which a lot of us believe is inevitable, with the loss of the subsidies only hastening it.

That doesn’t make Roberts a Liberal. It makes him a scumbag politician ;-)

See my post #26. This was a 6-3 decision. There was no need for Roberts to vote with the majority here, it was already a 5-4 decision.

In fact, if he was really being blackmailed he should have voted with Scalia and the rest because doing so would have reduced the credibility of the blackmail allegations.

Um, Roberts was nominated for O’Connors seat.

When Rehnquist died he was moved to the CJ slot. Meirs was then nominated for the open Associate Justice seat.

When Meirs imploded Alito was nominated for the AJ seat.

So there’s no way that Roberts was any sort or revenge plot to stick it to Conservatives. The revenge plot in your scenario would be Alito.

It is of no import except to confirm the ending of the Court as an independent branch of the Government. Now there is only on active Branch. The other two formal branches are, at best, advisory bodies only and serve to legitimize tyranny.
