I asked you to specify what is the “overt act” that underlies the charges. When and where did those 170 detainees conspire? If they have evidence of such, these people should have been already locked up.
Unfortunately, or not, ISIS members are fully human. They are not, however, US citizens (possible rare exceptions).
It is an evil regime, and their atrocities are well documented. They are at war with Western civilization, and other Muslim sects. Eventually, they will meet a strong opposition, until then their barbary is poorly checked.
