Dude flipped cop off to test his 1st amendment rights to freedom of expression = not a good idea
Saratoga Springs police released the camera they had confiscated on Saturday, showing officer Nathan Baker pepper spraying a man sitting in his car before grabbing the mans arm and twisting it out the window. Officer Baker claimed he was arresting Adam Rupeka for disorderly conduct.
Rupeka had flipped him off while driving past him. And while the New York statute for disorderly conduct includes a line about making an obscene gesture, the 2nd U.S. Circuit Court of Appeals, which encompasses New York, ruled that flipping cops off is protected by the Constitution.

Now those two cops were smart. They checked you out, realized you were not a threat, and went on their way. No power plays, no threats. In a word, professional.

You're probably right. But if the cop is stupid enough (or brutal enough) enough to go along with it, then too bad for the city. Make 'em pay.
But it's also possible that the motorist was being provocative not for the payday, but as a public service. Some folks actually do that! It's sort of like the cops setting up prostitute decoys, but in reverse.
Since you never knows who's a decoy, it would be wise to be on your best behavior at all times.
The officer never said he pulled him over for flipping him off. Chances are he will be able to dig up some other obscure Distracted Driver law or something like that to justify the stop. He only got the OC spray after refusing to provide his info twice, and then refusing to get out of the car. Of course providing the officer with his license and such wouldn’t have gotten him the response he wanted.

Yep. This could hinge on whether the threshold was met for a Terry stop, and whether the officer was being reasonable even if he did make a mistake. A jury may not be that sympathetic either should he choose to sue.
The proper response is "Is that your IQ score, or your number of friends?"

Certainly the ghetto culture part of society went too far in Ferguson and Baltimore.

What is funny is he may very well win the lawsuit he files, may not be much but we the taxpayer have to pay it for the officer who couldn’t control his emotions.

However, if you choose to USE THEM as a DISRESPECTFUL A$$HOLE then be careful... someone may just retaliate and KICK your A$$.
