NORMAN, Okla. -- By the end of June, same-sex marriage will likely be legal across the United States. As has been the case in many of the important questions brought before the Roberts Court, Justice Anthony Kennedy holds the swing vote in what will presumably be another 5-4 decision. Two years ago this question was sidestepped in Hollingsworth v. Perry when the Supreme Court ruled that the petitioners lacked standing, and thus did not rule on the merits of the case. However, under the current circumstances, with no procedural hurdles to prevent a ruling on the merits, Kennedy seems poised to cast the decisive vote in favor of same-sex marriage.
Kennedy has been instrumental in the the court’s three previous cases which increased the civil rights of gays and lesbians. Although Kennedy has often found himself siding with the court’s four conservative justices on many important issues, this decision will presumably solidify his legacy as one characterized by his willingness to stand up for the rights of homosexuals...
Although Kennedy voiced his concerns about eliminating a cultural norm which has endured for millennia as well as postulating whether Americans have been given enough time to debate the matter, the cost of failing to decide the issue at this time seemed to weigh more heavily on the justice.
As the arguments unfolded Kennedy seemed to shift from reluctance to acceptance. This became increasingly apparent when the states’ attorney, John J. Bursch, asserted incessantly that the bans on marriage were not an attempt to disparage same-sex couples or in any way strip them of dignity...
Although he demonstrated that he has some reservations about granting same-sex couples the right to marry, his commitment to seeking equality far outweighs those reservations. Expect a 5-4 decision ensuring a constitutional right to same-sex marriage.

Really doesn’t matter anyway. America has become one of the normal communists Countries of the world. Things will get worst, you can bet on it.
Always been my prediction.
I would rephrase it “Supreme Court likely to force same-sex marriage on the remaining states in June, per judicial decree, more persecution of Christian business owners and confiscation of their businesses as a result”
This is how it started in Nazi Germany. Germans had no sympathy for Jews who had their businesses confiscated in the early 1930s for their beliefs. Well, its happening here. And the GOP cowards are hiding.
Just a few years ago the SC overturned the DOMA saying essentially the federal government had no business defining marriage. Now they have no problem with being absolute hypocrites by redefining marriage.
Undoubtedly it will happen this way.
And it will be the reigning symbol for me of America’s final descent into moral rot and decay. After this point, the country really can just burn to the ground as far as I care.

The Court hasn't really worked the way the Founders intended, too much ideologies and legislating from the Bench.
The Problem is I don't know how to fix it.
Trust the Court to whims of Elections? Or Fixed Term limits would create packed courts.
And the thing about it is that Congress has the power to limit what the SC can do.
The capricious tossing out of the accepted definition of a word in favor of the definition of the moment seems to be a rather strange move. The legal system has always been based upon long accepted meanings and wording. The Clintonian malleability of a word seems like something that will bite the courts in the rump, and extends the power of the legislature to the courts.
Again, the sole remedy that the court should be considering is if marriage laws themselves are unconstitutional if they fail to include provisions for whatever gender (or number.) Any other legal remedy is legislating from the bench, and should not be done.
This was the ultimatum from the Massachusetts State Supreme Court - legalize gays shacking up and calling themselves married, or we’ll declare every marriage unconstitutional. Mitt Romney failed us when he gave in to such a ridiculous notion. The only proper response was ‘go ahead, make your decision’ and then challenged the annulment of all marriages.
I personally think everyone’s going to be ticked when the ruling comes down. I think that SCOTUS will cut the baby; rule that existing marriages, no matter what the makeup of the union, are valid and must be recognized by every state as well as the federal government. I think they’ll overturn judicial legislation forcing registration of any non-traditional marriage, and direct those who seek change to do so through their state legislatures.
I don’t think they’ll trudge down the path of ‘special case’ yet again, as those rulings have repeatedly caused problems for the court down the road.
Libertarian assholes(Glen Beck) that have jump on board the gay marring bandwagon have empowered the federal to be dictators over all of us...
Ted Kennedy knew EXACTLY what he was doing when he decided to bork Bork. It’s the gift that just keeps on giving.
There will be controversy however they decide, but just imagine what will happen if they affirm the definition of marriage that has existed for over 5,000 years and leave it to the states (as a Constitutional Republic should function) to determine what "marriage" means. There will likely be thousands of homosexual bullies screaming in the streets.
To me it distills down to this: Is upholding the Constitution, liberty and religious freedom worth whatever civil turmoil will likely result?
Ginsburg married two homosexuals and therefor should recuse herself. Saying that left wing judges have shown us that they care more about their agenda than the law i.e. Kagen over Obama care

The two are mutually exclusive and the gov. which is bringing this case admitted as much in their arguments.
