Supreme Court likely to legalize same-sex marriage in June, Justice Kennedy will cast decisive vote

NORMAN, Okla. -- By the end of June, same-sex marriage will likely be legal across the United States. As has been the case in many of the important questions brought before the Roberts Court, Justice Anthony Kennedy holds the swing vote in what will presumably be another 5-4 decision. Two years ago this question was sidestepped in Hollingsworth v. Perry when the Supreme Court ruled that the petitioners lacked standing, and thus did not rule on the merits of the case. However, under the current circumstances, with no procedural hurdles to prevent a ruling on the merits, Kennedy seems poised to cast the decisive vote in favor of same-sex marriage.

Kennedy has been instrumental in the the court’s three previous cases which increased the civil rights of gays and lesbians. Although Kennedy has often found himself siding with the court’s four conservative justices on many important issues, this decision will presumably solidify his legacy as one characterized by his willingness to stand up for the rights of homosexuals...

Although Kennedy voiced his concerns about eliminating a cultural norm which has endured for millennia as well as postulating whether Americans have been given enough time to debate the matter, the cost of failing to decide the issue at this time seemed to weigh more heavily on the justice.

As the arguments unfolded Kennedy seemed to shift from reluctance to acceptance. This became increasingly apparent when the states’ attorney, John J. Bursch, asserted incessantly that the bans on marriage were not an attempt to disparage same-sex couples or in any way strip them of dignity...

Although he demonstrated that he has some reservations about granting same-sex couples the right to marry, his commitment to seeking equality far outweighs those reservations. Expect a 5-4 decision ensuring a constitutional right to same-sex marriage.

people, did any of you really think there was a stopping of this juggernaut?....there is no stopping of it....

soon we'll have multiple marriages and everyone will be getting welfare and SS pensions aligned with their old cash daddy....

I don't know what will happen to the churchs...I suppose the Mormon and Catholic ones will just allow it all....afterall, the protestants seem to glorify it....

me?....I'm going to be a cradle to grave Catholic but not a very good one...I've pretty much not gone to church for some time, and I expect that will continue.

prayer is the only answer...

I am under no illusions.

When you consider all of the states that now have same sex marriage, it practically nationwide now anyways.

“This was the ultimatum from the Massachusetts State Supreme Court - legalize gays shacking up and calling themselves married, or we’ll declare every marriage unconstitutional. Mitt Romney failed us when he gave in to such a ridiculous notion. The only proper response was ‘go ahead, make your decision’ and then challenged the annulment of all marriages.”

It seems to me that’s going to be an issue if marriage is re-defined. Existing marriages would be annulled by virtue of the fact that the marriage they entered into no longer exists, and the old one has been deemed unconstitutional.

This is how it started in Nazi Germany. Germans had no sympathy for Jews who had their businesses confiscated in the early 1930s for their beliefs. Well, its happening here. And the GOP cowards are hiding.

Oh, they aren't hiding… they're actually helping.
Their soul is essentially owned by the Chamber of Commerce, and one of the reasons that Wiemar Republic -> Nazi Germany went from such dire economic condition to economic powerhouse is because when the Jews were dispossessed of their property it was real wealth, land, and money entering the economy in an accessible and/or liquid state.

Have the smartest lawyers in the land forgotten the obvious?

In every culture, marriage means that a male and a female agree to engage in intercourse where his semen is placed in that woman’s vagina.

If either partner cannot or will not engage in that type of intercourse, both Church and State in most eras declare the marriage annulled.

Only that act consummated a marriage.

So if homosexuals cannot engage in that type of intercourse, how can they be married? No vagina with men. No penis with women. Marriage act an impossibility, no marriage.

For those who say assisted conception make the old definition obsolete, they forget about the children.

Children have a right to know they were conceived by their biological parents in a passionate act of faithful, permanent love. No turkey baster. No petri didhes. No mad scientist parsing out the “ unfit”. No surrogate mommies to dilute the bonding.

We need to remember.

I hope that FReepers understand that if the Court legalizes same-sex marriage it is because the Court is corrupt, not because such marriage is constitutionally protected.

The last I looked they weren’t legalizing same-sex marriage, they were legalizing homosexual marriage. Has the language in the case changed?

DC desk jocky class has bought the myth of “born that way” or a “homosexual gene” rather than the scientific reality of behavior.

This is just a conditioning story. This is going to be just another abortion cause for the useful idiot crowd which politicians will use to divide us.

Bad language. We should not consent passively by adopting the other side's misleading language.

First: The Supreme Court cannot "legalize" anything. Only States can do that. The Supreme Court can (perhaps) enjoin States from enforcing their laws. It's less clear that the Supreme Court can invalidate State Constitutional amendments. But "legalize" something that's illegal by action of a State Legislature? Can't be done. Abortion has not been "legalized" nationwide. In those States where abortion is illegal, it's still illegal - those States simply cannot enforce their laws.

Second: The Supreme Court cannot amend the Constitution. Therefore, the Court cannot "ensure a constitutional right to same-sex marriage". There is no such Constitutional right unless the Constitution is amended in the ordinary way to provide same.

But, for the sake of argument, so what?

Many traits and even more tendencies are inborn. Not all of them are good. Some are very harmful - susceptibility to alcoholism, for example.

I have a tendency, probably inborn, thank God well-controlled at this time, to desire sex with different women. As I used to say before I abandoned the Episcopal Church, does this mean they should provide a rite for blessing motel room keys?

It makes absolutely no difference whatsoever to society, to lawmakers, or to the moral and ethical status of homosexuals whether the behavior at issue is inborn, is an acquired compulsion, or is a normal variant.

the USSC set precedence it does not have to respect prior rulings. This is why the “stare decisis” question in senate confirmations are just a show joke for rubes.
