Sheriff Clarke: Charge against cops a 'miscarriage of justice'

In an interview with Fox News’ “Your World with Neil Cavuto,” Milwaukee County Sheriff David Clarke dismissed the charges against six Baltimore police officers in the death of African-American man Freddie Grey as “political justice” and “a miscarriage of justice.”

CLARKE: It’s a miscarriage of justice. This neophyte prosecutor stood up there and made a political statement, Neil, and I say that because she chanting or voicing some of the chants from this angry mob. Her job is to tune that out. She said, ‘I hear the voices.’ She is not supposed to hear anything as she reviews this case that is not consistent with the rule of law and our system of justice.

Look, I’m an experienced and a veteran homicide detective. I’ve had — I’ve participated in charging conferences. There’s no way I have ever gotten a criminal charge within 24 hours after taking over all the reports and evidence to a prosecutor. A prosecutor who is thorough needs several days to sift through hundreds of pages of reports, they usually want to interview some of the witnesses themselves in person, and they have to sift through all of the evidence, piece by piece, and they have to wait for some of the forensic evidence to conclude to come back.

And that’s why I say on a minimum, three to four days. She just got this case yesterday. This is political activism. She’ll never prove this beyond a reasonable doubt and I’m not going to silently stand by and watch my brother officers offered up as human sacrifices, thrown like red meat to an angry mob, just to appease this angry mob. 

I’m sure he knows a lot more than we do.

Except, his statement was premised upon his mistaken understanding that the DA just got the case yesterday. His whole argument is that, because her office just got the case yesterdaay, she couldn't possibly have thoroughly reviewed the case to make a charging decision.

Only problem is that the DA's office has been investigating the case for over two weeks.

Teenagers made up the majority of rioters who caused chaos in the city on Monday night.

He is not declaring the accused innocent. He is saying that based on his years of experience there is no way a charge of murder can be submitted without spending days weighing the evidence and interviewing various parties.

But how could he know that she did not do that? He is under the mistaken impression that she only got this case yesterday (probably because that is when the police department delivered its report to her). But her office has been separately and independently investigating for over two weeks.

Maybe she’s deliberately destroying the case. One FReeper pointed out that the CNN video of the arrest starts after the point when the victim’s head flopped straight backwards. Then one of the cops holds his head up straight, and that’s where the CNN video starts. Now the original video has been taken down by YouTube.

So if there’s actual evidence the cops broke his neck in the takedown, how do you get them off? How about brazenly playing to the street and in doing so, compromising the case. That would enable the charges being thrown out later, or as an appeal.

Because yeah, if this prosecutor is trying to actually win the case - a case she knows damn well will be fought tooth and nail by the FOP defense attorneys, why screw-up on procedure right out of the gate?

Unless it’s not a screw-up at all.

He is an experienced former homicide detective. He knows the process by which charges of this magnitude are obtained. That process was circumvented in this case. As Sheriff Clarke said, there is no way that this prosecutor did due diligence on this evidence having just received this case yesterday.

You may be right. If Sheriff Clarke overstepped the facts here I expect that he will man up and admit his error. From all I’ve seen he has one heck of a strong sense of honor.

He isn’t wrong about the DA talking like a political activist and identifying with the mob. That was extremely unprofessional.

No one has mentioned the possibility of over charging so that he least guilty will turn— & tear down the “blue wall”!
When the evidence comes out it will sort itself out

What we do know is that the medical examiner over night changed the cause of death after meeting with her. I don’t trust anything this politically motivated racist says.

I agree with the Sheriff on this one. In an honest trial, there is no way to prove 2nd degree murder.

And the riots had no affect on their ability to investigate the case ? She just got it yesterday. You are not denying that. So she is not making a decision on her own because she cannot have read everything yet. That is what the Sheriff said. Precisely correct.

The police should have called that Commie female dog Angela Corey on her "Absolute Bullsh!t". I predicted that they themselves would be next.

And here we are...

BTW - I saw the charges, and it's the usual: "charge-larding" to the Nth degree.

The Founding Fathers would have backhanded today's "persecutors" bloody.

For example:

4. Manslaughter by vehicle (gross negligence). Ten years.
5. Manslaughter by vehicle (criminal negligence). Three years.
