After public outcry, Baugh apologized for the comments and acknowledged the short prison sentence violated state law. He attempted to revise it retroactively, but was blocked when prosecutors appealed.

Thanks for the link. So the judge acknowledged that the nearly 50 year old teacher raped the girl. And he acknowledged that she was raped without her consent. But the judge still thought the victim was equally in control and half responsible for the sexual assault, and although he did step back slightly from his decision (since he violated state law in giving the sexual predator only a month in prison) he is still justifying the decision he made.

I can see how he would say such a thing...if he understood the temptation of the rapist. It wouldn’t even enter the mind of a person with morals.

I agree. The judge was even sympathetic to the nearly 50 year old rapist because he said that the 14 year old girl “appeared older than her chronological age.” What difference does her appearance make???? She was his student! She was in his class with other 14 year old students. He had access to her records if he was in doubt! He knew her age. He knew that she wasn't 18. But even if she was, did that make it ok to rape her? According to the light sentence given by the judge, the answer is actually “yes”.

The statutory rapist needed a stiff sentence. But some of the participants on this thread have come close to presuming that a 14 year old is incapable of knowing right from wrong, especially where sexual transgressions are involved.

I agree that a 14 year old is capable of knowing right from wrong. But whether she was 14 or 40, it does not justify the rapist's assault.

Even the judge acknowledged that the girl had been raped. That she had not consented. Whether she was a “good girl” or a “bad girl” is irrelevant. She did not deserve to be sexually assaulted by her teacher.
