Why A Convention Of States Is Safe: Debunking The Myth Of A Runaway Convention

Our Founders wisely created the option of the Convention of States in the Constitution as a tool in case the federal government came to disregard the will of the people. Now some pundits are using scare tactics to misrepresent the Convention and what it could do to the U.S. Constitution.(Sarah Palin Channel)

"I’ve happily been advocating that America call a Convention Of States to propose amendments to rein in the Federal government."

"This is an option that our founders gave us in Article V of our constitution."

"They gave us Article V as an ultimate security check just in case the Federal government ever grew too large .. too corrupt .. too incompetent"

Sarah_Palin_Convention_Of_States_legislators

"Well folks, we’re there!"

"The time for this idea is now!"

"That’s why State legislatures around the country are voting on legislation calling for a Convention Of States."

Sarah_Palin_Convention_Of_States_Liberty_Amendments

"I first came to understand the need for a Convention Of States when I read my friend Mark Levin, whose best-selling book is The Liberty Amendments."

"It convinced me that the Convention Of States is the last recourse for Americans to rein in our out of control Federal government, because D.C. will never fix itself!"

Sarah_Palin_Convention_Of_States_06

"Everytime I bring up this topic critics start painting this scary picture of what might happen if we call a Convention Of States."

"Their biggest criticism is a fear that the delegates might disregard the purpose of the Convention and rewrite the entire Constitution"

"Let me put their minds at ease."

"There are four reasons why a Convention is safe."

Number 1 • The applications that the State legislatures are passing right now, define the topics to be addressed at the Convention. Anything beyond that scope is ‘out of order’.

Number 2 • State legislators send Convention Commissioners who are subject to instructions given by their State.

Number 3 • Lets just say for the sake of argument that reasons number one and number two failed. If they did, the Courts could declare their actions void.

Number 4 • Whatever amendments the Convention proposes will not take effect until three-fourths of the States ratify them.

"That’s 38 States. By definition, if 38 States agree on an amendment it’s not runaway. It’s a mandate!" – Sarah Palin

Sarah_Palin_Convention_Of_States_03

"Here’s the bottom line."

"We already have a runaway Congress and a runaway President."

"The founders gave us Article V of the Constitution to stop them."

"It’s time to use it!"

Sarah_Palin_Convention_Of_States_volunteer

"Checkout ConventionOfStates.com, where you can send a petition to your State legislator and sign up to be a volunteer."

"I do encourage you to get involved. It is time."

I agree with that possibility. There is something heinous in our nationwide leadership and it isn’t limited to DC. These people weren’t born in DC, they came to DC via their states.. The federal government can cut off all kinds of goodies, monies, close Military bases and deny FEMA to states. Don’t think they won’t and I bet we wind up without the second amendment. Are there really 38 states with the kind of bravery and will it would take to go against DC? They wouldn’t stop there, these people attack the children of those who do not comply. Palin of all people should know there are not 38 state leaders with that kind of fortitude.
They burn things down and destroy if it means they win. Operation Jade Helm will ensure everyone complies with DC, or else. We are living in Nazi Germany.

And the biggest reason to fear a Convention of States is because there is not one politician today who is worthy to lick the sweat of ANY Founding Father’s brow.

Today, with very few exceptions, politicians are obsessed with power and keeping it. ALL have higher expectations. There is ZERO concern for the will of the people. The people are only good for two things: donations and votes.

The fact that 38 states must ratify the amendments before they become law is of little comfort. The states will ratify whatever the people they sent to Convention come up with.

The states will send delegates with specific, limited commissions.

Among all peoples who love liberty, anything ratified by 3/4 of their legislatures or conventions ought to be in the constitution. It is called free government, and not a guarantee that mistakes will not be made like the 16th, 17th, and 18th Amendments.

So, if not a Convention of the States, your solution is...???

First you would have start by Neutering the Federal Government. Take away its control. If it can not be done then onward to a CC. If that doesn’t work then its time to seriously consider the last option.

You realize, of course, that a Constitutional Convention requires the approval and cooperation of the Federal Government you're trying to neuter.

Which is why a Convention of the States makes so much sense -- the Federal Government is totally out of the loop.

I was afraid i wasn’t very clear. A CC would be the second option.
First, or i should say this is our last chance, to dismantle the OVERREACHING part Federal Government. IRS,DOE,UN Welfare...on and on.
Actually, the only way a CC would work is with a weaken, more compliant, Federal Government.

My guess is we will continued to spiral downward. Not even a Cruz can save us now. Although, i am willing to give it a shot.
If we do continue to spiral downward some, how many is the question, will resort to the last option.

>>> The states will send delegates with specific, limited commissions.

Some questions on this. ow are delegates allocated? Is it a certain number per state or perhaps along the lines of electoral votes? Do the current bills being passed in the states include the same commissions? If so, does each state need to pass multiple bills to reflect the different issues?

How so?

The states are the authority, the Fed Gov is their client.

They can modify the commission of their client at will.

I kick myself for not bookmarking the FL delegate statute of last year. IIRC, it provided for the delegates to obey the legislature, for recall if necessary, and felony punishment if the delegates disobey.

The convention will be federal, one vote per state, regardless of how many delegates each state sends.

Commissions will vary from state to state.

No need for multiple bills.
