A California judge has reduced a child rapist's mandatory 25-year sentence down to only 10 - saying anything longer would be 'cruel and unusual punishment'. Superior Court Judge M. Marc Kelly told an Orange County jury that 20-year-old Kevin Jonas Rojano-Nieto 'did not intend to harm' the three-year-old girl he raped at his family home in June. The judge said that he was sure that although Rojano-Nieto sodomized the girl and covered her mouth so she couldn't scream out, 'there was no violence or callous disregard for the victim's well-being'.

I see I am not alone. I am finding more balanced coverage of what is happening in America in BRITISH newspapers than I am in our own. The media in this country is TOTALLY in the tank for every liberal idea known to man. Any news item that goes against any liberal nonsense is not to be reported.

how is what this guy did not as bad? how were his action not “preying on an innocent child”?. If anything the fact that he became spontaneously aroused at the site of a vulnerable three year old whom he could hear her mother calling for her makes this guy a serious long term problem. he needs to have his brain examined (both judge and perv). Im no shrink but is that not sociopathic?

Judge Kelly further showed empathy with the rapist in this case by stating, "Mr. Rojano did not seek out or stalk (the victim). He was playing video games and she wandered into the garage. He inexplicably became sexually aroused but did not appear to consciously intend to harm (the victim) when he sexually assaulted her." He added that the rapist "almost immediately" stopped his actions and "realized the wrongfulness of his act."
Judge Kelly made these remarks knowing the 3 year old girl suffered tissue injuries to her anus as a result of the sodomy she endured. He also made these comments knowing Rojano covered the little girl's mouth to remain undetected while her mother frantically looked for her.
I did not see any of this on the MSM. Figures.
I do think that the family should be the welcoming committee when he comes out of prison. Or start sending treats to fellow convicts on his cell block.
This is the sort of statement that could be brought up in a sanity hearing. By the prosecution.
He needs to get fired. Are Superior Court Justices in Orange County elected? I can't see this going well out there.

That is NOTHING compared to what I now offer. I can tell you what is “cruel and unusual punishment” is, it is to the child and the child’s parents.
My nephews youngest daughter was brutally raped and MURDERED by his ex-wife’s boyfriend. The boyfriend got LESS THAN 5 years and was out in 3. He walks the streets today and nothing is done to stop him for doing it again. As far as I am concerned, that “sentence” is indeed CRUEL AND UNUSUAL PUNISHMENT for my nephew and the rest of the family. If I had some terminal disease, I would make it my last dying effort to remove that bastard from society so he will NEVER be allowed to rape or murder anyone again. Animals like that do not deserve to breath air.
