Should President Obama, or any President, be allowed to serve a third term?

With the anniversary of the 22nd Amendment on Friday, Constitution Daily looks at two hot-button topics: Should a President be allowed to serve a third term? And should members of Congress and the Supreme Court have term limits like the President?

View photo .obamainaug1 The 22nd Amendment brought the idea of term limits into the Constitution. When it was ratified in 1951, the amendment limited a President from effectively serving a third term, by saying that a President who won two elections can’t run a third time. The 22nd Amendment also bars a President from serving more than 10 years in office, in a case of a President who assumed office as Vice President.

For example, Vice President Gerald Ford took over for President Richard Nixon in 1974 and served more than two years as president. If Ford had defeated Jimmy Carter in the 1976 presidential election, Ford could not have run for re-election.

Long before the 22nd Amendment, George Washington had set an unofficial precedent in 1796 when he decided several months before the election not to seek a third term. But Alexander Hamilton and many Founders wanted a strong executive, and they opposed term limits as a concept. Thomas Jefferson and an equally influential group of Founders supported term limits for the President.

The only person to break from Washington’s precedent was President Franklin D. Roosevelt, with a record-setting four election wins. Before Roosevelt ran for re-election in 1940, most Presidents didn’t try for a third term in office, let alone a third consecutive term.

How did I know this article was coming?

Obama will never leave office.

We are a dictatorship. Obama should try on some of those spiffy military-style uniforms. Ghadafi had a sense of style. Perhaps Obama can reach that level.

I will be killed or messed-with by the government for this post, BTW.

No you won’t. They don’t care what you and I think, and with the “Neutral” ObamaNet, they can finally silence us without losing our productivity.

If he wants to run again “because he’s concerned that no one can beat the Republican and, darn it, he just loves this country that much”, then Boehner will pass the necessary bills to make it happen because he loves bipartisanship that much.

No. never. there was a good reason for the amendment and nothing since then has changed that reason

Yes, Yes Yes for congress. If for nothing else, throwing out the bum(s) every few years will surely energize the parties to activity recruit new talent and maybe we can return to a era where citizens are actually engaged in the political process.

Supreme court should have long term limits but not elected. Say 10 to 15 years

I heard the same thing with Clinton and Bush... that they would do more than 2 terms, and set up a dictatorship.

Didn't happen in either case.

But it did gets lots of hits on the newsgroups back then...

No you won't. Rest assured that you won't. Few will read this, and the impact of your opinion on the overall electorate will be very close to zero.

Now of course the Government will be aware of what you said, but they will attract more negative attention to your point by bothering you than they would from leaving you alone, so they will leave you alone.

Now if you were being effective, and you were actually *HURTING* public opinion regarding Obama, then you might have some reason to be afraid. As it is, only some low level (relatively speaking) techie is like to even notice anything you've wrote.

And that is our sad reality. We aren't effective enough for the giant to notice. We aren't even gnats.

FDR died at 63 a few months into his fourth term and looked a decade or two older. I’d suggest the peacetime routine of the presidency only got nastier in the last seventy years, let alone the stress of wartime. I’d say to any president who seriously wants more than eight years that there are faster, easier and less painful ways to commit suicide.
