Obama to seek emergency order restarting immigration programs
The Hill ^ | February 20, 2015 | Mike Lillis

The Obama administration will seek an emergency court order to move forward with President Obama’s executive action on immigration.

Officials at the Department of Justice (DOJ) plan to seek what is known as an emergency stay that would essentially undo a Texas-based federal judge's injunction from earlier this week. If the stay is granted, the government could restart a pair of executive programs that will shield millions of undocumented immigrants from deportation.

White House press secretary Josh Earnest said DOJ will file for the stay by "Monday at the latest."

The emergency stay had been sought by immigrant rights advocates, who want to get the programs up and running as soon as possible while the appeals process plays out.

"We — as immigrants and as Americans — have waited for nearly a quarter century for these much-needed improvements to our broken immigration system," Marielena Hincapié, head of the National Immigration Law Center (NILC), said Friday in a statement. "We should not allow a flawed legal decision to delay these changes any longer.”

Making good on earlier vows, DOJ will also file a separate appeal seeking to restart the executive programs.

"We will seek that appeal because we believe when you evaluate the legal merits of the arguments, that there is a solid legal foundation for the president to take the steps he announced last year to help reform our immigration system,” Earnest said.

At issue are two new initiatives launched unilaterally by Obama on Nov. 20.

The first expands eligibility for the president's 2012 Deferred Action for Childhood Arrivals (DACA) program, which halts deportations and allows work permits for certain undocumented immigrants brought to the country as children. The second, known as DAPA, would extend similar benefits to the parents of U.S. citizens and permanent legal residents.

Combined, the programs could affect as many as 5 million immigrants living in the country illegally.

Many states, however, were quick to object. And Texas — joined by 25 other states — filed a lawsuit contending the programs marked an abuse of executive authority that would cripple their budgets with exorbitant new costs.

In a decision announced near midnight on Monday, U.S. District Judge Andrew S. Hanen agreed, arguing that the administration failed to comply with a federal law governing the adoption of new federal rules.

Hanen has not yet ruled on the merits of the states' complaints, but said they have a significant enough case that both the DAPA and expanded DACA programs should be put on hold until the legal challenges are resolved.

The effects of the decision were immediate, as administration officials quickly announced that they would not begin accepting applications for either program until the court decisions are final.

Before the ruling, the Homeland Security Department was poised to begin accepting applications for the expanded-DACA program this week, and the for the DAPA program in May. Both have been suspended indefinitely.

Hanen's injunction does not affect the original DACA program, which remains up and running.

I know there are plenty of third parties out there. What we need is another alternative to challenge the two major parties. The new party would have to develop its own message to attract significant numbers of voters from both major parties as well as independents. Immigration is one such issue.

His methods are transparent. Flood the nation with all manner of flotsam to engorge the dem votor base and destabilize the citizenry. Hugo Chavez did the same exact thing. The bum should have been arrested a long time ago.

” Amnesty is forever. If Obama’s executive amnesty is not stopped, the country is finished. Moreover, if we don’t drastically reduce the numbers brought in legally, i.e., the 1.1 million permanent legal immigrants who enter each year, the result will be the same. Amnesty just hastens the process. “

Legal immigration is destroying our culture. WAY too high!! I would place a moratorium on it.

” 1965 Immigration Act as the single most important factor that caused our downfall.”

Yep..LBJ only wanted votes, damn the consequences!

” The corporate paymasters ensure that both parties do their bidding even if destroys the country in favor of their bottom line. They socialize the costs and privatize the profits.”

Why this current GOP must do the bidding of its overlords, and give us Obamacare & amnesty.(see tagline)

Thanks for all the work you have done regarding immigration.

” a very high bar to meet”

Indeed. This is not ultimately in their best interest as another court affirming the injunction will be a PR setback.
I suppose Reid insisted on an appeal to give cover to his minions in the Senate, and/or the Dem-funded immigrant groups are insisting on an appeal- so they have something to show the immigrants they prey on.

Along with Teddy Kennedy. This was at the height of the civil rights movement. The Dems wanted America to look like the rest of the world demographically. At the time, non-Hispanic whites were 89% of the population compared to 63% today and according to the Census Bureau, 43% by 2060. By 2019 half of the children 18 and under will be minorities as defined by the USG. 87% of the 1.1 million legal permanent immigrants who enter annually are minorities. Immigrants and minorities vote more than two to one Dem. Demography is destiny.

No, they are not.

They are under fire from all sides now and they keep screwing up. And will continue to do so.

We just made huge gains last Nov. not just at the national level. State and local Gov'ts are majority GOP by far. CT, MA, and IL now have Repub governors which is devastating to the Dems because these are far left states.

The thing to watch now is the WOT. Obama is coming under more and more pressure on national security and the public is once again going to see his inadequacy. He has a Sec of Def now who is not going to just toe the line. We will see new splits in the Dem party, much having to do with war.

Another fun thing to watch will be the mounting frustrations over the ACA. They've put all their "good news" out there. Not much left. Now comes a wave of bad news. They are hanging themselves.

You haven't heard about the new Gov. of IL pushing for budget cuts and getting rid of the practice of money being deducted from paychecks from people not even in a union?

Much better to have a head of state pushing for those items rather than higher budgets and higher union dues.

Obama is winning. He is transforming this country whether it is gay marriage, gays in the military, amnesty and non-enforcement of our immigration laws. His 2012 Dreamer amnesty legalized 700,000 lawbreakers to date giving them work permits and SSNs.

Whatever gains you are talking about, I see little evidence of any real change. The ACA continues to be more and more imbedded into our healthcare system; the XL pipeline has yet to be approved; the Benghazi, Fast and Furious, and IRS scandals have yet to yield any convictions; state laws against gay marriage have been overruled in 27 states; sanctions against Cuba and Iran have been eased; the US response to ISIS remains weak and ineffectual (the same holds true for Ukraine); and Obama has his veto pen that will strike down anything that gets thru Congress that Obama dislikes. And on top of that, the GOP approved the budget for the rest of the fiscal year eschewing any use of it to stop Obama's profligate ways or amnesty.

Just as the 2010 election victory did little to stop Obama, I fear the same thing is happening with 2014. Twas a great victory. Obama's approval rating has been rising with Gallup having him at 50%. And the polls show Hillary destroying any GOP candidate.

THE CHEAP LABOR EXPRESS

COMING TO AMERICA-- murderers, rapists, pedophiles, thieves and drug dealers, paid agents of foreign govt's advocating the overthrow of the US govt. Coming to infest your communities, schools and workplaces w/ drugs, crimes and disease.

They're Coming to America but not on the LI Limited. No running water and flush toilets on those trains. How did the "new students and employees" handle body wastes on the trip over the border?

================================================

Those who advocate open borders should take heed. Huge quantities of heroin and cocaine have flooded across our borders, smuggled by pernicious drug trafficking organizations who've set up distribution networks allover the United States. Tens of billions of dollars from the drug trade, flow into the coffers of transnational drug trafficking organizations and international terrorist organizations.

There have been thousands of accusations of human rights abuse, extortion, and even reports of murder on the freight trains transporting undocumented migrants to the US border.

The real eye-opener is that these freight train companies are involved in the Narco trade, and one report makes it clear that the companies are aware of the abusive practices their train operators are engaging in. The border swarm is all about human trafficking, narco-trafficking, and government collusion.

The trains involved are publicly-traded companies, traded on NASDAQ, with "very influential stockholders", such as the billionaire Clintons and billionaire Mexico resident, Carlos Slim. Other stockholders include,T Rowe Price, Bank of America, and General Electric.
