College football star Jameis Winston's alleged rape victim gives up her anonymity

The woman who accused Florida State University star Jameis Winston of raping her has come forward for a new documentary.

Eric Kinsman, 20, speaks publicly in The Hunting Ground, which premiered Friday at the Sundance Film festival currently being held in Utah.

In the film, Kinsman details the night of the reported attack, as well as the harassment she endured while Tallahassee police reportedly botched their rape investigation.

She’s looking for a big payday from lawsuit against Winston as soon as he gets his NFL signing bonus. His lawyers will probably settle with her and then she will continue with lawsuits against FSU and City of Talahassee. It’s all about the money.

But I can't help noticing that freepers were overwhelmingly in favor of giving Duke lacrosse players the benefit of the doubt, and overwhelmingly in favor of giving an FSU football player nothing of the sort.

And it bothers me quite a bit that I think I know the reason why.

The totality of the circumstances might disagree with you. Look at the accusers. A drug-addled hooker with nothing to lose who saw dollar signs versus a college student from a good family with everything to lose.

Getting to the truth of the matter?

Rebuttal.
1) The investigating detective does not believe the accuser in this case. PERIOD. Why not? Because her story changed significantly during the three interviews.

2) The DA who was to prosecute the case chose not to bring charges? Why not?

The answer to this is unknowable because we can not read his mind.

The primary hypothesis is that he knows that he can not get a conviction because of the tox, DNA and witnesses in the case.

Positives:
Instant reporting of case:
At least in this case we have an instant report coupled with the requisite DNA and Tox screen evidence. That is a big plus in favor of the accuser. It allowed the necessary medical evidence required for a conviction to be collected.

Negatives:
- Accuser did not know the location of the alleged attack (alleged perps dorm room).

- Accuser did not know the name of the alleged attacker. This was not a ‘jump out from the bushes attack’. This was a ‘left bar with defendant’, ‘willingly took taxi ride with defendant and friends’, ‘willingly went into defendants dorm’, ‘willingly went into defendants room’, ‘willingly got onto defendants bed’ type of attack. So, during all this time, she did not get the defendants name?

- Accuser did not know the defendants height.
Defendant is 6’4”. Initial claim was that he was 6’2”. The second claim was that he was what, 5’-9” to 5’-11”. So not only do the police now not have a name, a location, they are also looking for a suspect much shorter than the perp.

- Accuser left the scene with the defendant on his scooter.
So she is reasonably sober (according to the drug test police soon administer). Yet she doesn’t know where she came from.

- Accuser told friends, who called into the police that defendant hit her on the head.
This claim was not in the two witness statements she made to the police.

- Defendant has two witnesses.
While they may be lying their asses off, the defendant’s two friends both told the police that she went to defendant’s apartment with him willingly. They further told the police that she willingly had sex with the defendant.

The DA does not appear to have a winnable case.

1) I don't think 'that' would be the reason. We don't need to go there.

2) No, we are not 'overwhelmingly in favor' of 'Duke lacrosse v FSU football player;...

To my shame, I was initially on the other side of the Duke case. Probably due to my bias against frats. Those posts were not on this site, but another. However, I did correct myself once the facts started coming out. Nifong getting disbarred was a good thing. 3) Most likely, they are just biased against FSU and for their alma-mater.

4) Alternatively, they are undercover feminist/democrats trying to 'win over the site' on an issue by employing specific methods of group control.

(ie. What Rush calls 'seminar callers'... You know, the ones that typically start off with "I am a life long Republican, but..."

- I don’t think that is a good assessment of the start of the case.
- The hookers ORIGINAL motif was most probably her desire to not go to jail. She was drunk as a skunk in public. The Cops had been called on her. She had the choice of going to jail right then or ... making a false complaint.
- I think she just chose the easy out.
- $$$ may have come later.
- But most likely, the case went viral and she was trapped in the lie and couldn’t get out easily.

Your counter point is: “a college student from a good family with everything to lose.(sic)”

- I don’t know enough about the circumstances of this ‘college student’
- Now that she has gone public, perhaps some intrepid people will do the research.
- She is promoting the movie, “The Hunting Ground”

The original poster intimated that skin color was the reason Duke got the benefit of the doubt while the FSU student didn’t. That’s really the only part I was replying to. If I hear a story about a hooker going to a college party and pressing rape charges and then hear another story about a student going to a bar and then pressing rape charges against a popular college football player, I’m going to give the benefit of the doubt to the latter. No matter what the skin color.

Back up the story for a bigger picture:

How does that line go... “When they came for the male college students, I did not complain because I was not a male college student...”

1) Republicans folded a year or so ago on refunding the “Violence against Women Act”

2) Now the Dems are attacking the Colleges using Title IX. Once they roll these 55, the rest of the schools will comply without question.
