BRANDON — Clarence Daniels had just crossed the threshold of Walmart's front doors on Tuesday, in search of coffee creamer for his wife, when the gun in hip holster gave a well-intentioned vigilante the idea he was up to something more sinister.

I live in NC half a mile from the SC border.
NC is open carry.
SC is not.
While getting out of my truck at a SC convenience store, my jacket hoisted up over my sidearm and was exposed. A SC sheriff was getting coffee and approached me asking for my CCW.
I showed him my NC CCW and he kindly informed me that SC was not open carry and I should make sure to keep it concealed while in his state.
I said, “We’ll do” and he told me to have a nice day.

Thats it.

This story has shades of the Jim Goldberg case in Copnnecticut.

As I understand it, he went into a local restaurant to pick-up some takeout he had ordered; a clerk saw his concealed holstered pistol and called the cops; *man with a gun*

Cops arrested him and it turns out they *misinterpreted* the law b/c much to the cops chagrin, CT is an open-carry state.

Goldberg won. Rogue cops get exposed.

Foster was arrested and charged with battery.

Good! Prosecute to the fullest.

in Tennessee you can choose to carry concealed or open, but you have to have a carry permit.

I don’t think most of those commenting on this article even read it. He saw him removing the weapon from his truck and donning it in a concealed fashion. That is totally proper. Even with concealed carry there are many places where you cannot concealed carry. Schools and government buildings for example and here in Alabama any business that post a sticker at the entrance disallowing concealed carry in their place of business. In those situations you are suppose to put the weapon in the truck and the ammo in the passenger compartment. It is understood and accepted to don the gun in the parking lot, else the police would have charged him. I do agree with an earlier comment that he was most likely racially profiled.

Renewed in 2013, good to see they re-wrote for inadvertent exposure. Thanks for advising.

As the 42 reply said “that” was changed in Texas, but previous, yes any exposing could get license pulled.

Looks like the poor guy's daughter was right there watching her Dad get assaulted. Instead of tackling the guy, Foster should of called 911 if he felt that a black man with a gun was such a threat.

Dude is so lucky he didn't get shot, and it would of been justified, but a nightmare if the liberal press got a hold of the story.

Permits are stupid. Do we need a permit for the 1st right in the Bill of Rights? The 3rd right? The 4th? 5th?

Why do we need a permit for the 2nd right?

My permit was issued Dec 15, 1791.

I agree with you regarding open carry — no permit required.

Concealed is a bit sneaky, so a permit seems fair, and such was the law throughout the USA until the early 1900s, as states wanted to disarm blacks, Jews, Irish, Italians, and other “undesirables.”

And, for the record, I hold multiple permits in 3 states and 3 counties.
