Washington Man Who Faces Years In Prison For Growing Medical Marijuana Has Cancer

A Washington state man who is facing at least 10 years in prison if convicted in a high-profile federal case over growing medical marijuana for personal use has been diagnosed with cancer.

Harvey, along with his wife, Rhonda; their son, Rolland Gregg; Rolland's wife, Michelle Gregg; as well as close family friend Jason Zucker are all facing federal marijuana charges for growing about 70 cannabis plants for their own medical use at the Harveys' rural home. The family's defense attorneys have maintained the pot patch complied with state law. Washington legalized medical marijuana in 1998 and recreational marijuana in 2012. Still, federal law classifies marijuana a Schedule I substance "with no currently accepted medical use."

The federal government has charged each with multiple felonies, including manufacturing, possession and distribution of marijuana, as well as possessing a firearm in furtherance of drug trafficking.

The family has said the firearms charge is due to the fact that they keep numerous firearms at the house, which is located in wilderness of northeast Washington state, near the U.S.-Canada border, for hunting and defense. But federal prosecutors say the presence of firearms shows the defendants were involved in drug trafficking.

In 2014, a federal judge ruled that the family cannot defend themselves against the charges by arguing their cannabis plants were for medical purposes and legal under state law.

The usual dosage is 60g of oil taken as quickly as possible. That's a lot of plants, NONE of which are smoked!

These people are following the God given desire/drive to SURVIVE!

God given needs and desires are the BASIS for our Constitution!

Shows how little you read the actual article. I didn't see anything about derived oil from plants. I read plants, pounds of marijuana and marijuana-infused frozen foods and the like.

Trot out all the "oil" treatments you wish, but you're stretching the assumptions to fit a case of freedom and conflicting controlling legal authority instead.

The amount of oil derived varies from plant to plant even if they are the same plant.

If you were dying of incurable cancer, would you rather on the side of too much medicine, or too little?

Side with all the draconian lizard laws you will. You're neither humane, nor human.

Why are you insisting on morphing this to your own little special cures? Nothing was said about oils of any sort.

You started with the nonsense about what I didn’t know with a snide remark and I reciprocated thusly. And now your call me inhuman and inhumane...make up your muddled mind why don’t you?

You are assuming the family sold pot and (at least from this article and a linked article) there is zero evidence that this is the case.

From my rough calculations and based on your 60 gram dose, 70 plants should be enough oil for about 1500 doses. How many times a day does one take it?

It should be, but you and I know that it won’t be. At the heart of this isn’t pot or its consumption - or distribution. At the heart of this is control and a power struggle by the feds.

Even the worst-case scenario of a vast 70-plant empire this doesn’t rise to the severity where the fads have any business interfering. As I said no one is alleging that they sold anything so there isn’t an interstate-anything charge pending.

The feds don’t like that the state has legalized the substance (FTR: I don’t either) and is chafing at the bit to stick its nose where it simply doesn’t belong. Now that they’ve initiated this persecution I fully expect them to double-down on stupid and do ANYTHING they need to do to get a conviction.

The plant weight itself is not the oil output. A gram a plant would be a above average.

The oil comes from the tiny little globules on the flower petals. They look like sparkles unless you magnify them.

The CBD oil does not come from seed oil. Common hemp oil comes mostly from seeds. 25g per plant from seed is not uncommon. This is a most prolific seed bearing herb.

Courts are often so cynical right now that if a convict has a serious or expensive medical condition they are likely to turn them loose, even if they are very guilty, confess, and were facing years behind bars.

Contrarily, there was some mention of [ooga booga] presence of guns demonstrating an intention to distribute illegal drugs as mentioned in the article (or linked therefrom).....

Sure...that's a BS claim, one which I wholly condemn.

As I've said in a couple of posts here (in between responding to oil zealots with agendas) is that this isn't a property rights case; it is a case of controlling legal authority. In this case, and many others not specifically delineated in the US Constitution, it is solely a STATE case in my opinion.

Finally, here's my final statement and/or disclaimer on the matter. I'm not against personal use of pot. I've gotten some good highs in my day from it. Once I had a wedge of Hash and it was a real trip - in 1971...loved it! But I never abused it and made it part of my regimen. If I had cancer bad enough, I might try it, but I'd first go for the high grade pharmaceutical OXY variants if they'd let me have it. I'll probably find out sometime soon. I have melanoma that has gone too far.

I was basing it on what some web site said. 2 to 3 oz of oil per lb of dried plant. Concentration is probably the key variable.

Yes, and we know that crops planted are NEVER diseased, stolen, eaten, destroyed, etc.

Not that diminishes the Rights and inherit Freedoms vs. the ‘all knowing, all caring’ gov’t at ANY level.

Why, I’m sure just a FEW more Laws (still selectively enforced, IF at all...but there to snag anyone, just in case) would make the utopian dream come into fruition.

I’m always a bit suspicious when it comes to counts ... 70 plants isn’t much ... and I know some states exclude clones under xx inches from the count as it’s necessary to keep production constant...

I imagine it would be possible to “rent” multiple 20’ by 20’ plots and be hired to tend their plants in order to bypass the co-op limits...

Seventy plants for personal use? They really need to come up with a better story than that.

Sounds to me like there were 5 of them who had formed a legal collective, and thus could grow 60 plants.

How big were the plants? Have you ever grown anything? The way most crops work is that you start with many more seeds than you end up with, and the way they are grown is that you thin out the crop as it grows. Gardeners routinely take out the smallest plants to allow the larger ones more room to grow. (70 plants is a garden, not a farm.)

Since they are still arguing over what the defense can be, I hope they are going to opt for a jury trial. Since recreational pot was made legal in 2014, the Feds are going to have a hard time finding 12 jurors who will vote for a felony conviction on an activity which is now legal.

We live in a pretty rural part of Oregon. Like almost every rural place in America, most houses have guns. The "Firearms=Intent to Distribute" is not going to go over well with a jury.
