I don’t know if I believe this.

The only portion I believe accurate is the Sunday morning announcement during church services, which I predicted Thursday. I also think Eric Holder is a Grand Master Racist.

The story doesn’t make any sense to anyone who understands how the process there works. The prosecutor has virtually no control over the grand jury.

Judge Napolitano has said that if a prosecutor wants an indictment, he can usually get one.

I think that is why people think what they do.

Maybe in Missouri that isn’t always true.

I’m recalling this Charles Johnson guy popping up on FR in the past in association with a controversial matter because I questioned his credentials and believability at the time, but I don’t recall how reliable he turned out to be then or just what the matter was.

If he’s fabricating for hits here he’s good, though, because several details sound about right and ring true, particularly the reasons for dragging out the announcement.

The most recent update to the second link says that a forced resignation of Wilson will be announced along with no indictment, which sounds about right as well, it’s an attempt to placate. He wouldn’t be allowed to serve after all this and would likely be endangered, so he’d have to leave the force no matter what.

In Missouri:

The Grand Jury is composed of twelve citizens who are chosen at random by a circuit judge, who presides over the Grand Jury. A new Grand Jury is chosen for each of the three Terms of Court held each year. Since the St. Louis County Grand Jury meets every Wednesday during the term, a Grand Juror can expect to serve approximately sixteen to twenty days during that period.

The Grand Jury's function is to make an important preliminary decision about a criminal charge: whether or not probable cause exists that a crime has been committed and that the accused committed it. All felony charges must be presented for consideration either by the Grand Jury or by an associate circuit judge at a preliminary examination, and a little less than half of the cases prosecuted in St. Louis County are presented to the Grand Jury. If probable cause is found in either of these equivalent proceedings, a "True Bill" is found, an indictment is filed, and the criminal charge against the accused may continue on to trial or plea of guilty. If probable cause is not found, a "No True Bill" is found, and prosecution of the case ceases. The Grand Jury, thus, determines the future of all criminal cases brought before it.


ST. LOUIS COUNTY PROSECUTING ATTORNEY


The prosecutor doesn't pick or control the grand jury in any way. He presents whatever evidence the jury asks for. Its not presented like a trial with a prosecutor and defense attorney arguing a case. The jury asks for evidence and calls witnesses of their choosing. In this case McCulloch removed himself immediately and handed the case off to an assistant prosecutor in case he (McCulloch) were to be called as a witness.

I'd doubt McCulloch had anything to do with the grand jury presentation, other than assigning the assistant prosecutors. It sounds like he's otherwise dotted all his "i"s and crossed all his "t"s.

They’re accusing him of ensuring Wilson is not prosecuted. It’s his job to bring charges against Wilson, but he may not want to and could be trying to get the case tossed.

Methinks that’s more because a prosecutor isn’t going to bring a case unless he actually has one. This is the infrequent occurrence where he is obligated to pursue prosecution, but there is no case to make.

It’s not the sensibility of the accusation which matters to Holder’s people, it’s the seriousness of the charge.
