All the people have to do on this issue is tell them the truth. Prosecutorial discretion permits an advocate for the people to negotiate lesser charges or completely decline prosecution in specific cases where the People's interest are not served or cannot adequately be represented [insufficient evidence, abuse of police power, abuse of evidentiary rules...]

It does not, under any currently recognized theory, permit the exclusion of broad classes of people. To do so is a violation of the Due Process Clause of the Fourteenth Amendment, of all legal precedent in the Federal Case Law and Common Law, and in several parts of the US Code.

To permit entire classes of US Persons an exclusion from the law is an injustice and is exactly the reason that the Civil Rights of Act of 1964 was written.

It is a violation of the Presidential oath which requires that he faithfully execute the office of the President of the United States, which explicitly requires of him a Constitutional Duty [to] "take Care that the Laws be faithfully executed."

It is also a High Crime.

Interesting concept. So we choose which federal crimes to prosecute and which ones to not prosecute.

How about this (from a future Republican president, after the Democrats in Congress fail to act):

THE IRS AND FEDERAL PROSECUTORS ARE HEREBY INSTRUCTED TO NOT PROSECUTE, OR TAKE ANY OTHER ACTION, AGAINST ANY AMERICAN WHO HAS PAID AT LEAST 20% OF HIS INCOME IN TAXES.

Goes both ways. What you see there just above is an EXECUTIVE FLAT TAX (of 20%).

The president in the execution of laws passed by Congress does not have ‘prosecutorial discretion.’ He is to faithfully execute the laws of the land.

Obviously, if anyone can pick and choose various aspects of any document to enforce, not enforce, half enforce, then that person really is writing the law and not faithfully executing it.

After all, under this theory of what counts as faithfully executing the law, all that matters is that somebody, somewhere, is being deported; anyone and everyone else can be allowed to work and stay. So the president could “temporarily” legalize 99.9 percent of illegal immigrants and direct the Border Patrol to hand out work visas to every subsequent border crosser, so long as a few thousand aliens were deported for felonies every year.

What if they are not working?

I am trying to find an unbiased and near 100% accurate source. I thought the Census Bureau might be the place. Maybe but I do not know enough to get the data I want. I did get some data that suggests that scores of working-age adults are not working. But I cannot prove legal or illegal, so far. For anyone who might be interested in how the Cencus Bureau provides access to much of its data..

The following is entirely superfluous -- except for anyone who might be interested in taking a look at the U.S. Census Bureau Data Ferret. They have alternative, less comprehensive means to get tables also.

There are plenty of tutorials at Census and other places -- this serves only as an effort to make us aware that it exists.

What follows can be for any country. I started with Mexicorruption because its government is driving their unwanted citizens here, interfering with our internal affairs to alleviate social problems in Mexico that they themselves created due to their avarice and matching criminal activities. IMO.

I expected to find appropriate U.S. Census data but found instead the Data Ferret, make your own tables. The data options make it pretty complicated though the procedures are fairly straightforward, I still have a long way to go. My example is very simple.

U.S. Census Data Ferret Requires allowing popups and Java.

Log in, requires email but it's suppose to be for when the size of the table is so great you can have it emailed to you hours latter.

For Data Ferret after entering your email address click Get Data Now or first do the Tutorials, Examples, or other options.

The first screen is a collection of data sets.

So I choose

• Current Population Survey
  1. "Race and Ethnicity",
  2. (click on the little magnifying glass icon for next screen)
  3. "Demographic Variables",
  4. "PENATVTY",
  5. "Jan 1994 - Dec 2006, Demographic-native country of sample person."

Then

• I clicked Browse/Select Highlighted Variables button and
• in the Browse/Select Variables & Values pop-up window
• I had to first click Select
• which for some reason automatically selects all countries; so
  1. I had to Deselect all values,
  2. locate Mexico in the list of countries and
  3. click it.

Now I'm back where I can simply move on to the get that "table" or I can select more variables (see below); first I created the "table" using just the one variable.

So I clicked the Step2 Button and that gave me

• a window with
• an icon selection saying "Make A Table";
• (there's a little pop-up immediately with information that's also on the next screen),
• click OK and
• the next screen is available.

The next screen is the spread sheet..

• drag the variable located in the upper right portion of the screen to the spread sheet,
• the first variable goes in R2C1;
• the little "?" marks are just to show where the data will be returned;
• Click GO Get Data button

.

That returns 6,745,048 as the value for

• "Current Population Survey,
• Race and Ethnicity,
• Demographic Variables,
• PENATVTY,
• Jan 1994 - Dec 2006, Demographic-native country of sample person".

Which I took to mean that of the individuals born in Mexico and living here enough participated in the survey to estimate that 6,745,048 people born in Mexico are now living here.. legally and illegally.

Close the window with the spread sheet. The other windows remain and you can add variables and get back to the spread sheet window to create other tables.

I added my second variable

• Current Population Survey
• Dec 2006 (Why that one? It was the first one that appeared to be available to use);
• "Earnings Variables",
• "Earnings Variables; PTERNWA; Jan 1994 - current; Earnings-weekly earnings, amount-recode".

My two variables are:

• PENATVTY - Country of birth
• PTERNWA - earnings per week

For Mexico I get: Total PENATVTY = 6,745,048 w/o PTERNWA, Total PENATVTY = 4,213 w/ PTERNWA, Average PTERNWA = 70.6, Std Err PTERNWA = 3.06.

For Canada I get: Total PENATVTY = 885,582 w/o PTERNWA, Total PENATVTY = 446 w/PTERNWA, Average PTERNWA = 129.3; Std Err PTERNWA = 18.94

I do not recall seeing it but I sure think that Total PENATVTY w/PTERNWA ought to be in thousands.
