LAUSD argued middle schooler can consent to sex with teacher [updated]

Last November, Los Angeles Unified School District lawyers fighting a civil lawsuit argued in court that a 14-year-old middle school student was mature enough to consent to having sex with her 28-year-old teacher, and that she bore some responsibility for what happened. The district's attorneys also introduced the girl's sexual history into the trial as part of their defense strategy.

Two legal experts sharply criticized the school district for using those tactics. They also said the case highlights a little-known conflict in California law: while the age of consent is firmly set at 18 in criminal cases, at least two appellate court rulings have found that in civil cases, it is possible to argue that a minor can consent to sex with an adult.

Last November's case involved a math teacher at Thomas Edison Middle School in Southeast Los Angeles who in December 2010 began a six-month sexual relationship with a girl who went to the school. The teacher, Elkis Hermida, was convicted of lewd acts against a child and sentenced in July 2011 to three years in state prison.

What kind of a country advocates giving up an enormous chunk of its own territory when things go wrong?

The chunk that happens to have the best farmland. And Silicon Valley, where the future is being invented right now. And the tenth biggest economy in the world.

How would it help America to just give it up?

If you’re mad about the colonization by a foreign country, why don’t you and the other 49 accept responsibility for giving up the border instead of blaming the conquered Americans who live here, and reclaim the state for America?

Everybody on this website opposes amnesty tooth and nail... But when it comes to California, oh, that’s different. “Let ‘em have it!”

I really don’t get it.

Would you agree that there are good people in Cali? I would.

Would you agree that Cali is also lib central of America? It’s a fact.

Would you agree that since the 60s, California has grown increasingly leftist and had an increasingly negative impact on America Overall? It’s hard to argue.

Would you say that the good people of cali have not only tried and failed to fix the state, but that the problems with it have gotten worse? They have.

So logically it makes sense to stop trying. Enough time has elapses and enough effort has been expended. California offers nothing the other states cannot supply in abundance.

In medical terms? Gangrene. Eventually amputation is required when all else fails. All else has failed.

I live on your border. I have had SWAT guys crawl through my rural yard because one of your third strikers escaping your utopia decided AZ was easy pickins and a way to avoid strike 3. I don’t like ducking bullets. So I am not inexperienced with your bounty to America.

But for a criminal case, a rap sheet as long as the guy's arm can't be introduced.

See??? I TOLD you after gay marriage was sanctified by the state that pedophilia would be legalized. They’ve been trying to normalize it for a long time anyway, arguing children are perfectly capable of consent and one day it will be legal. Polygamy and incest are next.
