Forensics expert to testify at Ferguson grand jury, attorney says

ST. LOUIS – A private forensic pathologist who performed an autopsy on Michael Brown will testify before the grand jury deciding whether to charge the Ferguson police officer who shot him, the attorney for Brown's parents said Wednesday.

Attorney Benjamin Crump confirmed that former New York City Chief Medical Examiner Dr. Michael Baden is scheduled to testify Thursday. Ed Magee, a spokesman for St. Louis County prosecutor Bob McCulloch, declined comment. Messages seeking comment were left with Baden.

Crump said Brown's parents are pleased that Baden will testify, but skeptical about the objectivity of the process.

In other words, the jury has been presented weak testimony and the prosecutor feels the need to strengthen his case. Also, this means the decision is weeks away, not hours.

The family said they wanted Officer Wilson arrested and tried for murder. Since that is now very likely not to happen, this is probably a face saving gesture for them and ambulance chasing Crump when the no bill decision comes down. Then they can say (with the appropriate tone of disappointment):

“Well, we’re disappointed but they heard our evidence. So everybody just calm down and respect the process and the grand jury’s decision.”

Or words to that effect.

It won’t matter what is said to the professional agitators and the brothers in the hood. They are going to act out regardless.

It will be interesting to see how the warning that Governor Nixon made about not tolerating another outbreak of violence is put into effect.

Pass the popcorn, please.

The DA recently said they were still hearing testimony and the decision would be announced mid to late November.

As recently as November 4, 2014 I stated that the Grand Jury in the Michael Brown case was still hearing evidence and had not made a decision. I also stated that I did not expect the Grand Jury to complete its work and make a decision until mid to late November. That timeframe has not changed.

I realize that this is a much anticipated decision and that there is daily, if not hourly, speculation about when the announcement will be released.

Once the work of the Grand Jury is completed and they have made a determination, my Office will advise the public and the media when their decision will be released. Until that notice comes directly from this Office, ANY AND ALL claims of an announcement date or time from any source, especially social media, are rank speculation and should be ignored.

Fox News needs to do better research! I SAW Dr. Baden on Fox News when he said he DID NOT perform a physical autopsy; that he had only viewed the sketches and other data resulting from the autopsies. ......He had nothing conclusive to say; just speculation about how certain injuries MAY have happened.

Because this guy gets beaucoup publicity AND BUCKS, it’s assumed he’s the greatest in the world. He has a name and that’s about it. I don’t have a great deal of confidence in anything he says. For the defense in the OJ trial:

“”DR. MICHAEL BADEN, former New York City coroner: Contradicted nearly all of pathologist Spitz’s opinions about fingernail wounds, thinks Simpson cut hand on glass shards; believes multiple killers used multiple weapons; killers should have gotten blood on skin and clothes; Goldman could have remained on his feet struggling with his killer for two or three minutes after being stabbed; didn’t recall telling national TV audience that Goldman remained standing for 10 minutes; reviewed film clip and said difference between two, three and five minutes was inconsequential because it was still five to 10 minutes from first stab wound to death. Dec. 17, 1996””

That's why I'm wondering what the hell the family and Crump is doing by bringing back Baden.

The full autopsy results were only recently released, including the toxicology reports.

Baden didn't perform a "second autopsy". After the first one, there isn't much left.

He I'm sure looked at the remains, and reviewed the preliminary report. But even when he was first called in, I don't recall him saying that the St.Louis M.E. had made any mistakes.

If he wants to get into some kind of pissing match with the M.E. he can, but Baden has never struck me as being dishonest or in any way stupid.

I wonder if his testimony is there to "diffuse" some of the anger when the no bill comes out.

I thought Cyril Wecht was a showboat.

Didn't know that about Baden and OJ.

I think they’re both pathetic as is Henry Lee who also was a defense witness in the OJ trial. You can count on some comedic relief when he’s on the stand tho’.

It’s like I said before. Their names are so well known that everyone just assumes they are hearing from the best.. I believe the old L. A. Coroner was of the same caliber - Noguchi? There’s something about the personality of people in that field that yields them respect whether or not they’ve earned it.

It’s only my opinion from observing these men over the years. I only know I groan whenever any of their names come up.

Great Idea! Wait until its freezing and spray those streets down with water the night before they release the GJ Results! Give the police ice grippers for their footwear.

We’ve been having several water main breaks in the St. Louis area lately. Maybe a couple of strategically located breaks when the announcement is made would help.

Sometimes youth have been known to open hydrants on warm days to cool off! Perhaps some youthful Blues fans would like to take the opportunity to flood the streets into an ice rink and get out their skates for a little practice!

Without commenting on Baden's skills, he's never met a camera or a microphone he didn't like.

His testimony in some cases has been viewed by other forensic pathologists as "what was he drinking?"

I believe this quote is somewhat instructive:

“He is very bright,” said a former classmate of Baden’s, who ran a big city medical examiner’s office around the same time Baden did. “But he has a propensity for giving out statements and testimony which are not entirely accurate.”
