Stunning federal corruption case moving forward with almost no media attention

Corrupt federal prosecutors presenting false evidence in order to shake down a blameless corporation and bring in tens of millions of dollars seems like a pretty dramatic story. Especially when former prosecutors support the charge and a chief judge acts on the allegations and takes dramatic action. Yet the media silence is deafening.

Eric Holder’s Justice Department is implicated in a dramatic and shocking case of alleged corruption that is so bad that the Chief Judge of the Eastern District of California has taken what can rightly be called the “nuclear option” and recused all the judges in the district from the case because they may have been defrauded by the DoJ prosecutors.

So far, aside from the local paper, the Sacramento Bee, it is only Sidney Powell of the New York Observer, writing in the opinion pages of that publication that has paid attention to what should be a prominent national media scandal. In brief, the Sierra Pacific Industries, a lumber producer, was accused by the federal government of starting a large wildfire, and fined $55 million, and compelled to hand over title to 22,500 acres of land. The only problem is that the prosecution was allegedly corrupt, and knowingly submitted false evidence.

In an extraordinary development, Judge England, Chief Judge of the United States District Court for the Eastern District of California, ordered the recusal of all the Eastern District judges from the case because of serious allegations that the Court itself was defrauded by the government in the original prosecution. To avoid any appearance of partiality, he has referred the case to Ninth Circuit Chief Judge Alex Kozinski to appoint a judge from outside the Eastern District to handle the case going forward. Judge Kozinski has excoriated prosecutors for failing to meet their legal and ethical obligations.

Morrison England was nominated by President George W. Bush on March 21, 2002, to a seat vacated by Lawrence K. Karlton. He was confirmed by the United States Senate on August 1, 2002, and received his commission on August 2, 2002. He became Chief Judge on October 31, 2012.

There are so very many scandals with this Administration, that it’s hard to keep up. I think I’m fresh out of “Outrage”, it was used up around the time the Fox News Reporter was spied upon, or was it when Lois Lerner was exposed? The scandals are like playing a game of Whack-A-Mole, smack one down, only to have two more pop up at opposing ends. It’s both disgusting and exhausting.

It will be years prosecuting Holder’s justice dept. Meanwhile, what’s the current justice dept doing? The source of the corruption is Obama’s White House.

Speaking as a former Prosecutor, I LOATHE corrupt Prosecutors. People really have zero idea the power of Gov’t. If they want you and yours, you can NOT stop them. Period. Ever. Add corruption and it’s all over.

Hope they hammer these guys.

The CA trial judge (not the fed judge) let them off with a written tongue lashing. Really let 'em have it, stern words. Lots of stern words. Below is from the Meorandum of law prepared by defendant, in support of its motion to vacate the settlement.

While the court elected not to sanction counsel for Cal Fire, 25 the court expressed profound concerns regarding the conduct of the state prosecutors. The court stated:

The sense of disappointment and distress conveyed by the court is so palpable, because it recalls no instance in experience over forty seven years as an advocate and as a judge, in which the conduct of the Attorney General so thoroughly departed from the high standard it represents, and, in every other instance, has exemplified.

(Ex. 24 at 20.)

The court also found that the state prosecutors created "a tremendous burden" on the court "by allowing a meritless matter to go forward," and that this ran afoul of their responsibility "to only advance just actions."

25 The court noted that its leniency regarding Cal Fire's counsel "in no way speaks to issues of legal ethics or compliance with the requirements of the State Bar Act." (Ex. 24 at 19-20.) The court also noted that its "lenity, prudence, and caution as it relates to sanctions against officers of the court should not in any way be seen as softening or mitigating the force of this Court's decision, findings and orders as it relates to Cal Fire. It simply means that, whatever else might be said about the conduct and advocacy of cited attorneys, it will not be sanctioned here." (Id. at 20.)

The federal prosecutors who framed Edwin Wilson were not punished; and a couple of them were later nominated and confirmed to become federal judges.

What about the $1.2 billion fine on Toyota for the alleged faulty throttles?
They had to pay to get Holder off their back. Same tactic the IRS used.
