A federal judge has struck down Arizona's ban on gay marriage and cleared the way for legally recognized same-sex unions in the state.
The ruling Friday by U.S. District Judge John Sedwick bars state officials from enforcing a 1996 state law and a 2008 voter-approved constitutional amendment that outlawed gay marriage.
Sedwick ordered the state to "permanently cease" its ban on gay marriage and declined to stay his order.
The Arizona decision came after the 9th Circuit Court of Appeals ruled on Oct. 7 that gay marriage prohibitions in Nevada and Idaho violated the equal-protection rights of same-sex couples.
Last week, the U.S. Supreme Court declined to hear appeals from several states seeking to retain their bans on same-sex marriage.
The move effectively legalized gay marriage in about 30 states.

It is now up to Attorney General Tom Horne to decide whether he will appeal or comply and instruct county clerks to begin issuing licenses to same-sex couples. After conceding in a court filing Thursday that the ruling from the U.S. Court of Appeals for the 9th Circuit would apply to Arizona, he’s widely expected to do the latter. It’s now likely just a question of when.
Horne is expected to have a news conference Monday to announce his decision. His spokesperson, Stephanie Grisham, said they are “ethically obligated to consult with their clients” about their next steps first.

They also want to use “gay marriage” to OUTLAW Christianity and close our churches after suing them into bankruptcy for refusing to “marry” homosexuals!!!!

I hope you’re right about that, but I see no evidence that anybody in Congress is going to do any more than gripe about it. Congress could rein in the out-of-control judiciary, but won’t.
This is the judicial equivalent of a fad. The judges are desperate to be “on the right side of history” - it’s all about their own egos, not the law. Funny how something (traditional marriage laws) that was taken to be the universal norm in this country throughout its history and for the last two thousand years is now, all of a sudden, unconstitutional. Something that was laughable thirty years ago is now deemed to be mandated by the Constitution.

The courts have basically ruled that laws distinguishing male and female are “irrational”. That says as much about their metaphysics as it does about their legal philosophy.
