I was afraid that was the answer. But what if say, 38 states banded together and said no to the feds?

I don't think you would get 38 states. Eight states (plus D.C.) have enacted gay marriage by votes of their legislatures (CT, VT, NY, NH, DE, MN, HI and IL); three states adopted gay marriage by popular vote (ME, WA and MD); and a number of states where it was imposed by court order have shown no real opposition to it (CA, MA, NJ, VA, NV, probably others).
